    In California, the driver can be charged if an alcoholic beverage is "accessible to the driver. " So even if the driver is not drinking, but it is accessible to the driver, it is an open container violation. I know this from an Ex-friend with Benefits that has too much personal experience with this law.

    The reason the limos and party busses get away with it is because there is a partition between the driver and the passengers (including the booze).

    A very personable supervisor in HK, Augustin Mendez only worked a few days in the speak easy during the 2 years CoVid shut down since March 2020.     This is not true, check with a local lawyer. No where in Mexico is drinking in a moving vehicle legal, even in the back seat.

    Got more details from the bro about this extortion incident by Tijuana policias.

    2 young guys and 2 girls were in a taxi leaving HK after 1 AM, heading to club Alebrije in Zona Rio. They wanted more beers and complained OXXO closed after midnight. Cabbie took them to a liquor store 5 blocks away, encouraged them to drink in the cab, while busy talking a lot on the phone with someone, which they could understand only a few word. Cabbie drove them around the area, taking the long way, so it looked like this cabbie set these kids up to get ripped off by his policias buddies. There are a lot of greedy, shady and ugly people in the poor third world who would abuse visitors every chance they have.

    While in Tijuana or any foreign countries, limit your exposures and take low profiles to avoid giving assholes opportunities to dick with you, like vendors, beggars, bullies, gang bangers, cartels, bar bouncers, policias. Stay nice and clean, avoid anything even remotely borderline illegal. Taking UBER or LYFT would be safer than taxis, as you at least have the drivers' IDs to take any measure against them later.

    When stopped by policias, try to take down their IDs and car license #s. I have cameras front and back of the car recording videos and audios, stop only at well lighted areas with people. I mentioned that to policias so they never tried to pull any shit against me.

    Busted for open beers in Tijuana taxi

    2 guys and 2 girls were in a taxi in Tijuana when stopped by policias. Policia found 4 open beers with the 4 passengers and demanded $600. They finally paid $150 to get off but the night was ruined.

    There are no laws against passengers drinking or open containers in vehicles in Baja California or any state in Mexico that I know of. Policias always trump up stupid charges to squeeze money out of noobs, like carrying Sildenafil in public ect. When accused of stupid charges people should call their bluffs, deny the charges, insist on policias call in Policias Turistas, their sergeants or captains, or going to the policia station to see the judge. That would put an end to their bluffs. While it's not a crime to have open containers in cars, as usual just avoid giving policias any excuse to fuck with you.

    Policias pulled me over a few times, smelled my breath, accused me of drunk driving, threatened me with big fine. I denied the charged, would not bribe them, refused to get in their patrol cars ect. After a few minutes they just gave up and went after other prospects. If you act weak, they will bullshit you and rob you as much as they can.

    The bros in this case thought the taxi driver set them up. More likely policias usually target taxis or cars loaded with people as it increases their chance of catching gangs, criminals or getting bribes.

    CBP arrests suspected drunk driver

    Wednesday midnight I was waiting in SENTRI lane behind a grey Toyota 4 Runner. The lines were slow due to shift change between 11:30 and midnight. It took me 22 minutes to clear compared to the usual 5-10.

    The $Runner was inching forward to the CBP booth. The agent asked the driver 1 question, shone his flashlight into the truck, looking. He then asked the driver to step out of the truck. The guy stepped out slowly, gingerly, a short guy, looking like a Chino. Suddenly 4 to 6 CBP agents were running toward the truck, surrounding the guy. The original CBP guy pinned the driver against the door, cuffed him slowly with no resistance. 2 CBP guys shouldered the driver towards Secondary Inspection tent. The driver was walking slowly with some hesitation, not normal.

    I drove to the booth, asked the CBP guy what that guy did to be arrested. He said the guy was suspected of drunk driving. They would arrest suspected drunk drivers and call in CHP to decide. He asked me if I was drinking. I told him I converted to Mormonism along with my HK fiancee just last week. He chuckled.

    I never knew CBP and the Feds would bother with DUI cases, as they are misdemeanors better enforced by state laws. Federal courts are just way to complex and expensive for these little pissy misdemeanors. But the Feds do have jurisdiction on DUI if it happens on federal properties, and they usually make arrest then hand the cases off to the states for prosecution. If you are convicted with a DUI, you will lose a lot pf privileges with the government, like SENTRI or Global Entry and may be security clearances. You may also lose your jobs or may have problems getting jobs in the future.

    A few airlines pilots were caught boarding their super jumbos with BAC above 0.08 grams alcohol per 100 ML of blood or 200 L of breath, ready to fly 500 passengers off to their vacations in the sky. Ground and flight crews sometimes noticed pilots and crews inebriate and alert authorities. People just cannot ride a bicycle drunk without accidents, left alone flying huge, complex airline jets flying around blind at 600 MPH. These are very serious situations with potentially dire consequences of hundred dead passengers. The guys quickly lose their pilot licenses and airlines jobs for good, also get shit on at every turn in their lives. The FAA would throw its huge FAR book at these pervs. But a few captains and first officers with major airlines are known to still hang around airport lounges, knocking down a few shots before boarding.

    So if you are impaired by alcohol, drugs or meds, like I know a few of you have been, don't drive the car across the border back to the US. Let someone drive it, or just sleep it off somewhere until you completely recover.

When you read about Mexico's Marinas with DEA agents arrested Ovidio de Guzman in LOS Mochis, only to face a cartel's force 10 x larger with heavier weapons, then to have AMLO ordered the Marinas to back down and release Ovidio, the whole thing smelled like a farce. Nobody is sure who's really governing Mexico.

    There is this evil culture of phoniness and hypocrisy practiced at all levels of people and institutions in the Latin world. Everything is just a phony show behind big facades religions, morality and nationalism where the ruling class with no conscience but with lots of muscles, guns, connections and power can sell drugs, traffic young girls, steal, rob, rape, murder innocent, vulnerable people whenever they feel like, so they can spend their blood money in fancy restaurants, high-price vacations, fake but expensive liquors, make green rains at strip clubs.

    Latin America countries, mired in deep shit with poverty, hunger and violence, should contract their countries to be governed by some sort of United Nations' organizations to protect and feed the population. It may not be too bad to hand their governments back to the colonists, blood suckers themselves but still far less greedy, corrupt, abusive and evil than local cartels and politicians.

    Polcias would have to test and prove it's illegal drugs before they can arrest you.

    My 1st time being stopped was like my 4th hour in Mexico ever in middle day so I was shocked and scared because I was already scared to be in Mexico and his 1st words were get in the van. It wasn't even stop, what are you doing in Mexico. 5 years later or so, at this point I look forward to speaking to them as it makes it more interesting. The last time I had a 10 minute conversation on legality of having a Viagra in my wallet. They don't scare me no more if they want my 50 dollars they can take it. I never have more than that anyway.

    Sunday I got stopped for a vehicle search at the border entry. Popped the trunk. They searched the glove compartment, then dug through my trunk, them the back seat area. Then they asked if I spoke Spanish because they want to see more stuff. Fuck that I shook my head and started to talk to him in my memorized Korean boy-band lyrics I had learned for my favorite chica who is obsessed with Korean boy-bands. Frustrated he cannot understand my made-up Korean, he waive me by.

    Lesson learned. Speak Korean in Tijuana even if you need to make it up. If you are white, speak German to Mexican LEO.
