The two elements of a crime are mens rea(intent) and actus reus(act). Most crimes require the two elements for a guilty verdict. The only exception is if the crime is a strict liability offence in which case, intent does not need to be proven.

here we go again. i will go back to the beginning to clarify my position then answer your questions followed by me not posting in this thread anymore. it’s getting very old.

a. this whole thing, from my perspective, started with you posting pictures of **** girls you had sex with and what it seem to me you were bragging about it. this of course could be a culture thing but my perception of you was that you were bragging about it. so, i questioned your intention and now your expertise, and instincts.

b. i have never called you a kiddyfucker, stupid or a liar.

c. from meeting you and knowing a little about you i have concluded that you are a pro with the sex biz in thailand. it is because of this that i have questioned your intentions and actions. i think the people in here that are trying to lynch you are doing so because they have been offended by your actions and by how you are trying to defend yourself. at times you have come across like a desperate man trying to clarify your position and “innocence.” maybe you don’t see it but it is here where you have dug a bigger whole for yourself and even made others (and myself) question you again and again.

d. your self-confidence sometimes comes across as arrogance to me but i think it is not how you intend to be perceived. it could be a cultural thing. but, at the same time you claim to have 20 years of experience in thailand (i believe you) yet your expertise and experiences have not given you the common sense that if you post pictures of minors you had sex with and not expect questioning of your intentions and actions then you have not learned much. it does not matter what reasons you had to post those pictures. you know, or should know that this is a sensitive subject to many men including the owner of this site. personally, i think that if **** girls are selling themselves is a sad thing but the world has bigger problems like hunger and aids.

that is not a direct answer in the context of questioning your instincts about her age (looks and demeanor) not about her behavior. i don’t know what you mean by average behavior. it could be a language thing. or you chose to make it a language issue when the question was a little harder to answer in a straight forward matter.

to answer your questions about my encounter with an **** girl:

1.) why did you barfine her if you have doubts ?
answer: because i still had plenty of time to confirm my doubts before anything happened.

2.) what would you have been doing if she would insist to be 19 ?
answer: i would have gone with my instincts (not believe her age) and not take her and get my money back.

you were more concerned about your lousy 500 baht barfine than about the girl. i would have talked to her and explained how she probably will end. maybe would have invited her to look for another girl that i have to take instead of her. i also would have given her another 300 baht to reward her honesty and for loss of income.

we can not avoid them totally even if we try as hard as we can. we can only try to minimize the casualties.
