There's places where filming on one's phone (or GoPro) isn't welcome or acceptable, be it unwelcome from the staff or other customers. So using it in a manner that might make management think you might be taking photos isn't bright.

I doubt it was actually seized directly from his hand, They likely asked him to hand over phone and flicked through his pics. This has happened to me a couple of times when I held my phone up too high and one of the girls on stage thought I was taking pics.
