I have been a very big HELP sipporter, but after going there last Friday, I would have to say. its time to shut the doors. Like all the post before mine, the girls are week and think to much of themselves. The music is catered to the EUROS, and they are out there dancing with each other, holding hands,touching, and almost kissing, and I am talking about the dudes doing this to each other. I was told the DJ there is gay, and that has alot to do with the selection of music.

Man this shit been going on for sometime now, the problem is many guys mostly "rookies" or guys that been to Rio a few times get afraid and pay these chicks their "keep your mouth shut money" I call it, BUT there are cases were a chick will go to your place on the agreed price and then get to your place and ask for more $$ and IF you don't give it to them! They will start breaking your stuff and crying they will call up their friends and the boyfriend that is a police to beat you up.

How to stop this? A monger need to weed out these chicks that run around with Known "crooks" and "con-artist" if these slick chicks get paid off just ONE time to just sit around on the sofa and get drunk and dance off your dime guess what? They will do it again and again why should they stop?

I mostly only like to deal with a girl that is standing or sitting alone by herself either in the termas or in Club Help those are the ones that are their to get her paper and get paid and isn't looking for any problems.

WIth all this talk about what is legal and what isnt. How is an escort agency like Karla Models legal? As I understand it, the ruling was that taking advantage or abuse meant that the person was forced into the acts. So, this would not apply to the Termas situations, thus not making them illegal. You are right: on the surface, the body text of Article 229 was changed to read "estabelecimento em que ocorra exploração sexual", i.e. "establishment where sexual exploitation occurs". Based on the interpretation that no sexual exploitation occurs in a termas considering that the girls are there of their free will, this would indeed mean that termas would be legal.

At the same time, the heading of Article 229 maintains the wording "Casa de prostituição".

Now, of course, the crux of the matter is: what constitutes sexual exploitation, and who determines that? And that's where the newly amended Penal Code doesn't say anything explicity.

But very interestingly, Article 231 (regarding international and domestic trafficking of a person for purposes of sexual exploitation) reads as follows. First, let me quote Article 231 for international trafficking:

So in others words, according to the amended Brazilian Penal Code, prostitution is considered another form of sexual exploitation.

IMHO, the principal legal problem of termas was that maintaining a "house of prostitution" used to be illegal per se. Whether they were making money off the sexual services of others was a secondary issue. You are right, now the issue is whether they are benefitting from other's prostitution, and I agree with you... based on that alone, they are still on quite shaky ground.

I am not sure this law will change why thermas are on "shaky" grounds. The new ruling deals with the issue of forcing a person into prostitution, which is always illegal. The problem thermas have is that they make money off the sexual services of others. In Brazil, and the US for that matter, it does not matter whether the prostitute is forced into the life or not, but the act of living off the earnings of a prositute (pimping or pandering) is always 100% illegal.

I think some others may have tried to make this point already. The problem for thermas is that they have to always deal with the "pandering" issue.
