1. Trump was duly and fully Impeached. Twice. You are apparently thinking about Trump not being convicted by the Senate and, therefore, not barred from running for office again on those grounds. That is a separate issue.

But, I agree that it is an important aspect of it and ought to be factored in to the case against all the members of the House and Senate who are also Constitutionally disqualified from holding office on that "given aid or comfort to the enemies thereof" thingy; Any member of Congress who did not support Trump's Impeachment or vote for his conviction when he was duly and fully Impeached for inciting an Insurrection against America fits that criteria perfectly.

2. The Constitution says nothing about a legal conviction being required to accept a previous oath-taker's actions being enough to disqualify him to hold office. Aside from the fact that sworn testimony from mostly members of his own Party and even in his own administration gave witness to his repeated attempts to obstruct and overturn the Constitionally-sanctioned and required confirmation of a repeatedly proven free and fair election, he himself has not uttered or offered one shred of evidence or reasoning for why he sat on his butt for over 3 hours watching his Insurrectionist mob attack and eventually kill several police officers in their coup attempt without doing ANYYHING to stop them, despite being urged to do so over and over again by his staff.
