You mean prostitution has ALWAYS NOT been illegal. Yes, it's not illegal in and of itself, but the activities that result in prostitution are illegal rendering the industry impossible to operate without breaking the laws unless law enforcement looks the other way. It's not legal in Canada like in Germany where there regulations on prostitution.

From news articles surrounding this issue, I understand that the court did not legalize prostitution, but just said that the laws were unconstitutional and would be returning the question of how to deal with prostitution to Parliament. Meaning that the conservative government of Canada could re-write laws prohibiting prostitution, but not violate the constitution.
