Until quite recently, prostitution was totally illegal in Germany. Well, kindof.

Not true. Prostitution itself was not illegal, but supporting it by anything more than renting out space. Exactly this was the legal loophole the FKK clubs used: They provided FKK environment, and allowed people to do whatever they wanted. But even doing the bills for the girls would have been illegal. Now, the situation had changed.

In 2002, during the Red-Green coalition, prostitution was “legalized” in Germany. Well, kindof. Quite humorously, a law was enacted in Germany in 2002 that specified that from there on now, a sex worker had a right to her (or his, or its) money.[...] Sex workers can (and must) carry health-, unemployment- , and social security insurance.

Not quite. If they are self-employed, they are responsible for their social security as like other self-employed person in Germany. They may, but they need not enter the federal social security systems. And, in fact, most of them are self-employed. They come when they want to, they work where they want to.

The backdrop of this law wasn't foreign workers. It was unadulterated governmental greed: The government wanted to participate in the money made. Via taxes. Since 50% taxes are not unheard of in Germany,

Nobody in Germany pays 50% taxes. Apart from that, the goal was to legalize the trade in order to separate the good guys from the bad guys. And that worked. Anyone who is earning illegal money in Germany with prostitution (this is: using force or threat or abusing the lack of knowledge of foreign girls) would be a complete idiot. Some again and again tried it after 2002, with one result: The legal competitors hurt them with their pricing, and, as a nice addition, submitted some info to their new friends, the police. At any place which places ads on state-operated buses, like Artemis, one can be sure that the conduct there of any illegal practice would be as likely as the sale of illegal drugs at Karstadt.

Another reason was that more and more lawyers were of the opinion that undue restrictions of prostitution would be unconstitutional, as any restriction to the exercise of a profession has to be proportional with respect to the legitimate goal it should achieve. "Morality" is not such a goal, but an objective value has to be defined, since, according to the German consitutional law, it is not the duty of the state to tell its inhabitants how they should live, and what they should consider normal. Some judges, particularly in Berlin, started to review the existing laws, and the government did not want to get a "test case" to the Constitutional Court. This was why the Prostitution Act got enacted. I will include a translation of that short below.

Still problematic for the trade are the zoning laws, particularly in Berlin: Brothels are regarded as commercial enterprises (Gewerbebetrieb), which are restricted in residential or mixed areas. In mixed areas, they are legal as long as they do not "objectively disturb". And some local authorities think that they do, not because of morality, but simply because lots of customers walk in and out, park their cars, etc. This is the reason why most bigger brothels are located in industrial areas.

Only by making the taking of money legal, the government could demand their take in taxes. Everything MUST be logical in Germany.

This, too, is not true. Cf. Section 40 of the German Revenue Act (Abgabenordnung) explicitly states: "For the purposes of taxation, it shall be irrelevant if any conduct which, in full or in part, constitutes an element of a taxation rule, constitutes a violation against a legal rule, or against good mores."

And now for the real perversion: According to published reports, unemployed women were offered sex jobs from the governmental agencies, and when the women turned the offers down, the unemployment benefits were reduced or denied.

Not true. It turned out that the press reports related to bar (not erotic) staff at night clubs, and that the jobs were offered to people who used to work at other night clubs beforehand and entered this as the employment they were looking for in the forms.

The downside of the (kindof) legalization: The public health authorities ("Gesundheitsamt") now don’t have a legal basis for mandatory health checks. They have been abandoned.

This had to do with the new Infektionsschutzgesetz (Infectious Diseases Protection Act) and not with the Prostitiution Act.

According to the law, prostitution is still illegal, and represents a misdemeanor or regulatory offense, for which the sex worker can get issued a summons. Kindof like a traffic ticket. § 184d is still on the books, it can land a sex worker in jail for up to six month if she (or he) "persistently violates a restriction to perform acts of prostitution in certain locations or at certain times." Meaning: Local (or any) governments can still declare their city, or their whole state a “Sperrbezirk”- if they are so inclined - and make it off-limits for prostitution.

It is not quite like that. The declaration of a Sperrgebiet is regulated in Art. 297 EGStGB (Act Implementing the Criminal Code), which gives the State governments the right to order by statutory instrument:

- for a whole town with up to 50,000 inhabitants,
- for parts of any town with more than 20,000 inhabitants, or
- for public roads, parks, etc. independent from the size of the town for a whole town
that is shall be illegal to perform prostitution, as far as it is necessary for the protection of the youth or "public morality". The State governments may transfer this right to other authorities. However, prosititution may not be limited to certain single roads or house blocks.

Berlin does not have such a statutory instrument. In any case, prostitution cannot be banned out of a complete state.

The socialist/conservative coalition that is now in power is making a lot of noises that the abovementioned law did not work, and that more controls are necessary. A backlash is entirely possible.

Exactly that government - a conservative ministry - has published an opinion according to which any ban of prostitution would be unconstitutional. Thy only want to introduce a licensing requirement. The "big players" in the trade support this idea (probably because they would get rid of some minor competitors that way).

Here is the translation of the Prostitution Act as promised by me (I translated it by myself):

Section 1
In case that sexual acts had been performed against a remuneration agreed upon before, such agreement shall result in an enforceable claim. The same shall apply in cases where a person keeps him-or herself ready for the performance of such acts for a certain period of time against a remuneration agreed upon before, in particular in connection with an employment relationship.

Section 2
The claim cannot be assigned (to a third party), and can only be asserted in one's own name. The only defence available against a claim according to Section 1 sentence 1 shall be complete non-performance, but against a claim according to Section 1 sentence 2 is shall also be partial non-performance with relation to time. Apart from the defence of performance (section 362 of the Civil Code), and of limitation (of action), all other defences shall be excluded.

Section 3
With respect to prostitutes, the limited power of the employer to give instructions within the context of dependent activities shall not prevent the assumption of (such activity forming) employment within the meaning of social security laws.
