    Modified Visa Rules

    This just came in from the American Embassy in Kiev. The main thing for mongers is to note points 1, 4 and 5:

    UPDATE ON CHANGES IN UKRAINIAN IMMIGRATION LAW
    The following information was conveyed to the Embassy informally by representatives of the Ukrainian Border Control authority and the Department of Citizenship, Migration and Registration. This information is not intended as an authoriative source of information about Ukrainian immigration laws and regulations but rather as a general guide. For specific information regarding individual cases American citizens should contact the appropriate Ukrainian authority or employ services of legal counsel.

    An unofficial English translation of the text of the Resolution of the Cabinet of Ministers of Ukraine #917 from July 11, 2007.

    “Registration is done for short term visits - for foreigners and stateless persons from countries which have visa regime - for the duration of the visa, but for no more than 90 days, unless otherwise stipulated by the international treaties; for foreigners and stateless persons from countries with a visa free regime - for the period of up to 90 days during a 180 day period, unless otherwise stipulated by the international treaties; after Ukraine's entry into WTO - for foreigners and stateless persons from WTO member-countries - for no more than 180 days during a year.”

    1. The provision of Resolution 917 regarding the requirement to show sufficient funds at the border upon entry into Ukraine is not in effect at this time pending issuance of a list of countries that fall under this regulation by the Cabinet of Ministers of Ukraine.

    2. Regarding employment in Ukraine.

    • If a foreigner intends to travel to Ukraine for employment, the employer in Ukraine must obtain a work permit from the Ministry of Labor. A copy of this permit is sent to the applicant. The Appicant applies at a Ukrainian Consulate for an IM-1 visa. IM-1 is good for one year, but is single entry. After the applicant enters Ukraine, they submit their passport with an IM-1 visa in it and the original work permit to their local Department of Citizenship, Migration and Registration (DCMR) and get a stamp in their passport saying "Employment authorized until <date>." This stamp allows the person to leave and re-enter Ukraine as well as remain in Ukraine with no limits until its expiration. If the contract is longer than one year, then shortly before the stamp expires the employer must apply to the Ministry of Labor for an extension of the work permit. If the extension is granted, the work permit and the passport are brought to DCMR and are extended. No new IM-1 is required.

    • If a foreigner enters Ukraine without a visa and decides s/he wants to be employed, the employer must apply to the Ministry of Labor for a work permit. This allows the person to remain in Ukraine and be employed for the duration of the work permit. The person will also need to register this permit with the DCMR. However, if s/he leaves Ukraine, s/he must obtain an IM-1 visa from a Ukrainian Embassy or Consulate abroad, re-enter Ukraine with this visa, and then receive the DCMR stamp mentioned in the paragraph above to be able to travel in/out of Ukraine with no limitations.

    • Family members. Ukrainian law has no provisions for registration of minors (under 18). Spouses/family members of IM-1 holders are not automatically entitled to IM-1 status. However, if they intend to stay in Ukraine for more than 90 days, they must have a visa--most likely a P-1 (private) visa. When the IM-1 holder registers their work permit at DCMR, they should request the same status for their family members. Family members will receive a different stamp (most likely a permit for temporary residence), which will allow family members to stay in Ukraine and travel in/out the same way the IM-1 holder has.

    3. Generally, foreigners can obtain Ukrainian visas (including IM-1) at any Ukrainian Consulate outside Ukraine. They do not have to travel to their home country to apply for a visa.

    4. A computer system for counting the 90 and 180 days under the new provisions will be in place at all ports of entry soon. Counting will start on the day of traveler's first entry into Ukraine after the Resolution came into effect. It is the responsibility of the traveler to make sure that they are in compliance with the provisions of Ukrainian immigration law.

    5. If traveler were to arrive at a Ukrainian port of entry and Ukrainian border authorities determine from the their records that traveler has used up their 90 days, it is possible that the Border Control officer will not permit traveler entry into Ukraine.
