(Reuters). The USA Food and Drug Administration confirmed on Wednesday the receipt of reports that another caffeine drink. 5-hour Energy, may have been involved in a number of deaths. In this case 13 over the past four years.
The reports were first detailed by the New York Times on Wednesday.
The news follows the FDA's disclosure last month that it was investigating reports of five deaths that may be related to Monster Beverage's namesake drinks.
The highly caffeinated beverages are the fastest-growing type of soft drink in the United States, with sales increasing 17 percent last year to about $9 billion, according to Beverage Digest.
FDA spokeswoman Shelly Burgess said that 5-hour Energy, sold by Living Essentials, has been mentioned in some 90 FDA filings since 2009, including more than 30 that involved serious or life-threatening events like heart attacks, convulsions, and in one case, a spontaneous abortion, the New York Times reported.
The Times said another federal agency, the Substance Abuse and Mental Health Services Administration, reported late last year that more than 13, 000 emergency room visits in 2009 were associated with energy drinks alone.
But Elaine Lutz, spokeswoman for Living Essentials, the company that distributes 5-hour Energy, said in a statement that the product "is not an energy drink" (the so-called shot comes in a bottle that holds less than 2 ounces).
"Living Essentials," the statement went on,"takes reports of any potential adverse event tied to our products very seriously. We fully comply with all of our reporting requirements." The company was "unaware of any deaths proven to have been caused by the consumption of 5-hour Energy."
Currently the FDA does not publicly disclose adverse event filings about dietary supplements, including energy shot drinks.

I watched an interview with the CEO of 5 hour energy drink on ABC News. I am not sure if he was lying or telling the truth, but he said he did not know what we're all the ingredients in the energy drink. Also, there is no FDA regulation to disclose all the contents in the drink. So, you could trigger a heart attack by drinking something you do not know what is in it.

Twinkies Maker Hostess Going Out of Business, CEO Blames Union Strike

Hostess, the makers of Twinkies, Ding Dongs and Wonder Bread, is going out of business after striking workers failed to heed a Thursday deadline to return to work, the company said.
'We deeply regret the necessity of today's decision, but we do not have the financial resources to weather an extended nationwide strike, ' Hostess CEO Gregory F. Rayburn said in announcing that the firm had filed a motion with the USA Bankruptcy Court to shutter its business. 'Hostess Brands will move promptly to lay off most of its 18, 500-member workforce and focus on selling its assets to the highest bidders. '
Hostess Brands Inc. Had earlier warned employees that it would file to unwind its business and sell off assets if plant operations didn't return to normal levels by 5 pm Thursday. In announcing its decision, Hostess said its wind down would mean the closure of 33 bakeries. 565 distribution centers, approximately 5, 500 delivery routes and 570 bakery outlet stores in the United States.
Hostess suspended bakery operations at all its factories and said its stores will remain open for several days to sell already-baked products.
The Irving, Texas-based company had already reached a contract agreement with its largest union, the International Brotherhood of Teamsters. But thousands of members in its second-biggest union went on strike late last week after rejecting in September a contract offer that cut wages and benefits. Officials for the Bakery, Confectionery, Tobacco Workers and Grain Millers International Union say the company stopped contributing to workers' pensions last year.
NBC's Savannah Guthrie read a statement on "Today" from the bakers' union that said: 'Despite Greg Rayburn's insulting and disingenuous statements of the last several months, the truth is that Hostess workers and the union have absolutely no responsibility for the failure of this company. That responsibility rests squarely on the shoulders of the company's decision makers. '
Rayburn responded that he had been 'pretty straightforward in all the town hall meetings I've done at our plants to say that in this situation I think there is blame that goes around for everyone. '
He denied that the decision to shut down could be a last ditch negotiation tactic to get the union back to the table.
'It's over, ' he said. 'This is it. '
Rayburn, who first joined Hostess earlier this year as a restructuring expert, had earlier said that many workers crossed picket lines this week to go back to work despite warnings by union leadership that they'd be fined.
"The problem is we don't have enough crossing those lines to maintain normal production," Rayburn told Fox Business.
Hostess said that production at about a dozen of the company's 33 plants had been seriously affected by the strike. Three plants were closed earlier this week.
The privately held company filed for Chapter 11 protection in January, its second trip through bankruptcy court in less than a decade. The company cited increasing pension and medical costs for employees as one of the drivers behind its latest filing. Hostess had argued that workers must make concessions for it to exit bankruptcy and improve its financial position.
The company, founded in 1930, was fighting battles beyond labor costs, however. Competition is increasing in the snack space and Americans are increasingly conscious about healthy eating. Hostess also makes Dolly Madison, Drake's and Nature's Pride snacks.
If the motion is granted, Hostess would begin closing operations as early as Tuesday.
"Most employees who lose their jobs should be eligible for government-provided unemployment benefits," Hostess said.

Proposed law scheduled for a vote next week originally increased Americans' e-mail privacy. Then law enforcement complained. Now it increases government access to e-mail and other digital files.

A Senate proposal touted as protecting Americans' e-mail privacy has been quietly rewritten, giving government agencies more surveillance power than they possess under current law.
CNET has learned that Patrick Leahy, the influential Democratic chairman of the Senate Judiciary committee, has dramatically reshaped his legislation in response to law enforcement concerns. A vote on his bill, which now authorizes warrantless access to Americans' e-mail, is scheduled for next week.
Revised bill highlights:
-Grants warrantless access to Americans' electronic correspondence to over 22 federal agencies. Only a subpoena is required, not a search warrant signed by a judge based on probable cause.
-Permits state and local law enforcement to warrantlessly access Americans' correspondence stored on systems not offered "to the public," including university networks.
-Authorizes any law enforcement agency to access accounts without a warrant. Or subsequent court review. If they claim "emergency" situations exist.
-Says providers "shall notify" law enforcement in advance of any plans to tell their customers that they've been the target of a warrant, order, or subpoena.
-Delays notification of customers whose accounts have been accessed from 3 days to "10 business days." This notification can be postponed by up to 360 days.
Leahy's rewritten bill would allow more than 22 agencies, including the Securities and Exchange Commission and the Federal Communications Commission, to access Americans' e-mail, Google Docs files, Facebook wall posts, and Twitter direct messages without a search warrant. It also would give the FBI and Homeland Security more authority, in some circumstances, to gain full access to Internet accounts without notifying either the owner or a judge. (CNET obtained the revised draft from a source involved in the negotiations with Leahy.)
It's an abrupt departure from Leahy's earlier approach, which required police to obtain a search warrant backed by probable cause before they could read the contents of e-mail or other communications, the Vermont Democrat boasted last year that his bill "provides enhanced privacy protections for American consumers by requiring that the government obtain a search warrant."
Leahy had planned a vote on an earlier version of his bill, designed to update a pair of 1980s-vintage surveillance laws, in late September. But after law enforcement groups including the National District Attorneys' Association and the National Sheriffs' Association organizations objected to the legislation and asked him to "reconsider acting" on it, Leahy pushed back the vote and reworked the bill as a package of amendments to be offered next Thursday. The package (PDF) is a substitute for H. R. 2471, which the House of Representatives already has approved.
One person participating in Capitol Hill meetings on this topic told CNET that Justice Department officials have expressed their displeasure about Leahy's original bill. The department is on record as opposing any such requirement: James Baker, the associate deputy attorney general, has publicly warned that requiring a warrant to obtain stored e-mail could have an "adverse impact" on criminal investigations.
Christopher Calabrese, legislative counsel for the American Civil Liberties Union, said requiring warrantless access to Americans' data "undercuts" the purpose of Leahy's original proposal."We believe a warrant is the appropriate standard for any contents," he said.
An aide to the Senate Judiciary committee told CNET that because discussions with interested parties are ongoing, it would be premature to comment on the legislation.
Marc Rotenberg, head of the Electronic Privacy Information Center, said that in light of the revelations about how former CIA director David Petraeus' e-mail was perused by the FBI,"even the Department of Justice should concede that there's a need for more judicial oversight," not less.
Markham Erickson, a lawyer in Washington, D. C. Who has followed the topic closely and said he was speaking for himself and not his corporate clients, expressed concerns about the alphabet soup of federal agencies that would be granted more power:
"There is no good legal reason why federal regulatory agencies such as the NLRB, OSHA, SEC or FTC need to access customer information service providers with a mere subpoena. If those agencies feel they do not have the tools to do their jobs adequately, they should work with the appropriate authorizing committees to explore solutions. The Senate Judiciary committee is really not in a position to adequately make those determinations."
The list of agencies that would receive civil subpoena authority for the contents of electronic communications also includes the Federal Reserve, the Federal Trade Commission, the Federal Maritime Commission, the Postal Regulatory Commission, the National Labor Relations Board, and the Mine Enforcement Safety and Health Review Commission.
Leahy's modified bill retains some pro-privacy components, such as requiring police to secure a warrant in many cases. But the dramatic shift, especially the regulatory agency loophole and exemption for emergency account access, likely means it will be near-impossible for tech companies to support in its new form.

Don't care what anyone says. I'll stick by my words when I said the Sosua we once used to know and love officially died December 2010. Two black guys from Nigeria speaking in their language, Juan valdez minus the donkey, and two Latinas with so much ass that I would have stopped them also. There are ten customs agents with four actually working. But 20 people were waiting. The agents standing around had there hands in their pockets shooting the shit. The female agents standing around had guy agents all trying to make them smile, goofing off. Half of me wants to stand and yell" this is bullshit" but I know I will miss my connecting flight if I cause a ruckus. I wanted to tell the agent to have his boss call my boss because their is a misunderstanding, but I was wrong in the first place in not filling out the form correctly. They lead me down another long hallway and have me take a seat. A lady calls someone and I play dumb and say I thought she called me. Since I was next in line anyway they interviewed me next.
As they searched my luggage I had a confession to make to get ahead of a potential problem. I said" There is something in my luggage that can be a problem but its just food". The agents look at me then at each other. I say" That is dehydrated asparagus', they say WTF. It looks like 80 green joints in a bag. You see when I travel I stop by this health store for snacks that won't spoil. Its like flavored potato chips but healthier. They take a wiff and I eat some to convince them. They lead me down another long halway. The Black and Cuban agents stop and greet every agent we pass and kiss all the female agents. I say I have a plane to catch and they say"no problem". We pass the customs exit after baggage claim with my escorts. Okay they are going to escort me directly to the gate. They open a door and I go through as the agents and the door close. WTF, these jokers escorted me to the steet in front of MIA airport. Now I got to run to concourse D and wait in a long ass line. I made my flight right before they close the planes door. The lesson here is take time out to properly fill out everything on the forms.

NEW YORK (CBSNewYork) — A study by the Department of Health and Mental Hygiene has found that large parts of the city are plagued with soaring rates for multiple STDs – including HIV / AIDS.
The study surveyed 181 city ZIP codes for concurrence in rates of HIV/AIDS, chlamydia, gonorrhea, syphilis and hepatitis B, as well as two non-sexually-transmitted diseases – hepatitis C and tuberculosis. The diseases often occur among the same populations, the study noted.
The study said 33 percent of all the ZIP codes in New York City were in the top quintile citywide for multiple sexually-transmitted diseases during a survey taken in 2010. Among the most severe examples is ZIP code 10474 in Hunts Point, the Bronx, where rates of hepatitis C, chlamydia, gonorrhea and HIV / AIDS all ranked in the top 20 percent of all New York City ZIP codes.
Faring even worse was ZIP code 10457, in the Tremont section of the Bronx, which ranked in the top quintile for all seven diseases surveyed. Forty-three percent of residents in the neighborhood live below the federal poverty line, the report said.
Overall, the Bronx also had the greatest percentage of ZIP codes – 68 percent – in the top 20 percent citywide for multiple STDs.
Nineteen ZIP codes with high rates of poverty in the South Bronx, north-central Brooklyn and northern Manhattan saw top-quintile rates of HIV / AIDS, chlamydia and gonorrhea, the study said.
HIV / AIDS and syphilis both ranked in the top quintile in 13 Manhattan ZIP codes – representing Chelsea-Hell's Kitchen, Central Harlem-Morningside Heights, East Harlem, Washington Heights-Inwood, and Greenwich Village-SoHo, the report said.
HIV / AIDS and hepatitis C both ranked in the top quintile in 23 ZIP codes in the South Bronx, north central Brooklyn, northern Manhattan, Chelsea-Hell's Kitchen, and the Rockaways in Queens, the report said.
Hepatitis B and tuberculosis were most prevalent in areas with large foreign-born populations, including ZIP codes in Flushing-Clearview, West Queens, Bayside-Little Neck, and Ridgewood-Forest Hills in Queens; and Sunset Park, Bensonhurst-Bay Ridge and Borough Park in Brooklyn, the study said.
Only Staten Island had no high-morbidity ZIP codes.

LAS VEGAS (CBS LAS VEGAS) – Watching excessive amounts of online pornography can adversely affect a person's short-term memory and decision-making ability.
In the first study of its kind, German scientists linked the brain's ability to complete a task, reason, and understand concepts with people's viewing of pornographic images. The 28 heterosexual men in the University of Duisburg-Essen study were tasked with viewing a combination of pornographic and non-pornographic pictures while also trying to keep their order straight.
The men – an average age of 26 – viewed the pictures and were asked to touch a 'yes' or 'no' key to indicate whether the mixed sexual and non-sexual images had been seen four slides before. The study found a significantly greater amount of wrong answers from the men who viewed more of the pornographic images.
The men who saw slideshows of clean images scored an average of 80 percent correctly, while men who were viewing the pornographic images only scored 67 percent correctly.
The researchers believe that the findings could help psychologists and psychiatrists to better understand why Internet-porn addicts miss appointments, neglect relationships and even forget to sleep. Previous research linked the processing of sexual images with the areas of the brain that are responsible for emotion, arousal and attention.
'Sexual arousal interferes with working memory, an important facet of executive functioning, ' study author Christian Laier, a graduate student studying under psychologist Matthias Brand, told The Daily Mail. 'Sexual arousal and its impacts on cognitive processes might explain parts of these negative effects. '
Previous research found that watching pornography can actually cause some parts of the brain to shut down in order to redirect blood and cognition toward the parts of the brain responsible for sexual arousal.
The findings were published in the November edition of the Journal of Sex Research, and the researchers said they are now looking to conduct more tests with subjects other than heterosexual young males.
'The study is a first step, ' writes Laier. 'Our results need to be tested with respect to gender and sexual orientation to verify. '

If politicians fail to cut a "fiscal cliff" deal before Jan. 1, it means a lot less money in your pocket, period. This is especially true for lower-income earners, who will be hit hardest proportionally.
To illustrate the danger the fiscal cliff poses to Americans right now, at Christmastime, we used the Tax Foundation's tax calculator to produce a few examples of how Americans in various life situations will be affected.
Our first example is Manuel -- A young fellow who makes about $50,000 a year working at a newspaper.
Manuel, a single man with no dependents
What he pays now: $9,075
If we go over the fiscal cliff: $10,313
Difference: $1,238
Manuel's income tax rates will rise, and the payroll tax holiday will expire. As a result, he will pay an additional $1,238 in taxes -- and he'll see the difference immediately in his first paycheck.
Parents will be hit harder than people without children. Anne, for example, makes just $40,000 as a hospital receptionist, and she is a single mom.

What she pays now: $4,268
If we go over the fiscal cliff: $6,048
Difference: $1,780
In addition to increases in her income and payroll taxes, Anne will lose out because the per-child tax credit will fall from $1,000 to $500. For her, that's a 42 percent tax increase.
Stephen and Alexandra -- a two-income family with two children -- would be hit even harder. He makes $60,000 as a firefighter, while her job as a Catholic school teacher pays $40,000.

Their tax bill goes up because they would not be allowed to claim the per-child tax credit and would have to pay the 26 percent Alternative Minimum Tax for part of their income. All told, their taxes would rise by $7,650 -- more than 50 percent -- to $21,950 per year.
The fiscal cliff also means that Uncle Sam will take a bite out of the retirement money many seniors rely on. An increase in the tax rate on investment income, combined with the move to tax dividends as ordinary income, means that Harold and Phyllis, a retired married couple, would see their taxes nearly double!

Fenton and Sarah, the wealthiest couple in this cast of characters, earn $750,000 in combined salary as a stock analyst and lawyer. They also have $250,000 in investment income, $50,000 in dividend income, two kids and a mortgage. These members of the fabled "1 percent" face a tax increase of $79,224, or 28 percent.

Overall, nearly 80 percent of households will pay more money to the federal government as a result of the fiscal cliff deal.

I sit down at a table with five guys I don't know, say my grace and start eating as they look at me. Its 12:56 as I head to the number 1 slot, no bus is there. I ask an employee where is the Sosua bus, and he says its moved to slot 6 and was now boarding. Got my seat over the place that I put my luggage to watch it when we stop. A mile from Metro the car shuts down and the driver gets out and grabs a coolant jug from the trunk. Its now 12; 15 and he looks fucked. Fuck this I grab my two bags and start walking. The guy starts walking with me WTF. He wants his money. I don't have time to argue so I just keep walking, then I see another taxi. The sight of the first taxi driver standing in the heat, holding a coolant jug, and a half mile from his car made me give him 100 pesos. I give the new cab driver 150 pesos when we arrive Metro.
I walk into Metro at 12; 30 and say I want the 1pm bus to Sosua. She says there is no 1pm for Sosua that bus ends at Puerto Plata. The next Sosua bus is 4; 30pm. FUUCCCKKKK! I grab my bags and head to the taxi stand to ask for a taxi to Caribe tours to catch the 1pm to Sosua. These MF start shaking their heads no and saying Sosua. So now everyone here knows I'm going to Sosua and no one wants to run me down the street for just 150 pesos and loose there place in line. Another taxi sees my problem and offers me a ride for 150 pesos.
Its 12; 45 when we arrive Caribe Tours and I buy a ticket (330p or 380p). The number 1 bus slot has Sosua on it and no bus is there. I decide to run upstairs for a quick sandwich. There are six tables there and all of them are full of guys chatting and no food. Its like a Dominican Starbucks. I sit down at a table with five guys I don't know, say my grace and start eating as they look at me. Its 12:56 as I head to the number 1 slot, no bus is there. I ask an employee where is the Sosua bus, and he says its moved to slot 6 and was now boarding. Got my seat over the place that I put my luggage to watch it when we stop. A very nice looking MILF sat next to me showing some leg. I put my jacket around me as I fell asleep. Fun City its on.Carib Tours buses going to Puerto Plata, end in Sosua. The Metro bus line that goes to Santiago, I think that ends in Sosua also.

To get there you take the road towards Caberete and turn right just after the old Sosua car wash, it is about a 3 minute drive up the hill. Very good place with decent monthly rates. Biggest swimming pool on the North Coast, more like a small lake.
You will definetly need wheels if you stay there. They do have a shuttle but not sure how often it runs.

Travel in the DR is very simple and easy. Talk to locals when you are not sure. Caribe and Metro go everywhere and there are gua guas and hack drivers to fill the gaps. Be patient and you can get around no problem and very little expense. In enjoy the travel. It is often very entertaining.

I'm planning my next trip to Sosua that won't be to Sosua as it turns out.
Sitting at a departure gate at O'Hare aiport not too long ago. Was heading down to Miami for a 5 day business trip to see a man about a horse (try to close some business for my company). In the process of getting to the departure gate, I was singled out for a pat down by the TSA that was so intimate that one of us should have tipped the other when it concluded. I got body scanned too. It can be such a circus. They might as well have an agent making balloon animals as you exit security. It was between this dumb-ass thought and other * thoughts that I was having when I heard the words "over" and "sold" over the depature lounge PA system. I was up and at the gate counter before the guy next to me could put his laptop away as we surely had the same idea. Turns out my flight was oversold by 1 seat. In exchange for my seat I was given a boarding pass for a flight two hours later and a $450 travel voucher to fly anywhere in the world American Airlines flies. There is only 1 place in the world that American Airlines flies that I had in mind at that moment. I'm going to Disney World! Err, I mean I'm going to Sosua! I folded up the voucher and placed it in my wallet right next to a "mental note" that I placed in there as well to apply this voucher to POP as soon as I get back from Miami.
The problem started 5 days later due to me not heading straight home right after landing in Chicago as planned though. Upon exiting the airport I got a call from a good friend of mine asking for a favor. He had been communicating with this one girl for a while and she was driving up from St. Louis to spend a day with him. She was arriving that night AND she was brigning her girlfriend with her. He needed me to be "Goose" to his "Maverick." He wanted me to wing up or jump a grenade if necessary at the restauarant that he had already reserved for the 4 of us that night in downtown Chicago. Known this dude for 30 years (since we were 7) so couldn't say no. It was actually good to see him getting back into the game a bit. He's currently trying de-tangle from his psychotic baby-mamma. It wasn't so much the fact that she broke into his email, cellphone, and bank accounts. Not so much the fact that she called and issued death threats to all of his ex-girlfriends (they got restraining orders) or the fact that she tried to stab him through a closed door (his turn to get a restraining order). When that didn't work she left a suicide note on his car window and disappeared for three days only to be forcefully committed to a mental facility after police found her holed up in a hotel room but alas this wasn't it either. The true kick to this cluster of a f*ck was that none of the above bullshit helped him in court that very morning. He was still losing his custody battle against this psychonaut. The girl he was meeting tonight would be a first step in getting past all that. Famous last words.
I get to the restaurant first. He shows up soon after being followed by 2 chicks that can only be described in Latin Genus terms as Hoodus Ratus Maximus (hood rats). And when I say hood rats I do not mean in terms of origin but more so as a state of mind and chosen lifestyle. We all know that it's not about where you stay, it's about how you're livin'! Anyway, we grab a table and try to strike up a conversation. Now my friend was raised by a single mother and has atleast 4 sisters (his poppa was a rolling stone) so he is pre-programmed to to treat them real nice with open doors and nice restaurants and such. This algorithm played itself out as both hood and rat had their run of the drink and food menus for the next hour. It was actually hood that made the call of calls that would end the evening (for me atleast). After a few minutes of silence she grabbed my friends attention from across the table and she says "I don't know why why'all took us to this nice place and whatever. You could have just taken me to get me some chicken because I'm ready to suck some dick!" She then commenced to staring us both down. To be real though I froze. Then I dropped my fork. It clanged about 40 times on my plate before clanging 50 more times on the table and then bounced on my lap, then the seat and then finally to the floor as transfer from potential to kinetic ended. It was as if she was saying that all she did was suck dick and eat chicken; and she's all out of chicken. The first 2 lines of that one Rick James song did run through my mind though. You know the one.
At this point the Mary Jane Girls (as I was now calling them) went to go powder their nosees or whatever the equivalent is that hood rats do. When they were out of sight I immediatley brought out my wallet and took out two items. First item was the "mental note" that I had placed in there to book a flight to Sosua using the voucher. I threw it out. The second item I took out was the voucher itself and pressed into the palm of my friend's hand. I told him to use it to go to the Dominican Republic. Not ifs, ands or asses. I've been trying to convince this dude to leave the country and check out what we all know and do whehter its Pattaya, Angeles, Roppongi, Rio or wherever but he has always played me off like a crazy fool for even thinking it let alone going out and doing it like I do. He feels that he must have an African American woman to keep it real so to speak. Like I said, pre-programmed algorithm. I opted not to bring out the soap box on that one. He had never even left the country before and this was to be his "Escape From Chicago" Snake Pliskin style. From what I could see he was stuck between a GFE turned "nutty as squirrel sh*t" baby-momma and a no-hope-of-GFE girl that wanted only to eat his dick with some fava beans and a nice chianti. That voucher was his perscription to take a week's dose of fine uncut chica ass and some GFE latin-style for what was ailing him. The Mary Jane girls were still not back from the restrooms. It had been a while. They were probably in there doing kegel exercises. It was time for me to head out and get home as I was exhausted. I rested my case stating that the voucher had to be used during the week of spring break or it would expire and I was too busy that week as I was already going somewhere else that week."Where are you going to be that week of spring break" he asked. The first study looked at the scale, scope and nature of envy incidents triggered by Facebook and the second at how envy was linked to passive use of Facebook and life satisfaction.
The researchers said the respondents in both studies were German but they expected the findings to hold internationally as envy is a universal feeling and possibly impact Facebook usage.
"From a provider's perspective, our findings signal that users frequently perceive Facebook as a stressful environment, which may, in the long-run, endanger platform sustainability," the researchers concluded.

Consumer confidence socked by payroll tax hike
USA consumer confidence took a dive this month, wiping out all the gains of 2012, a drop fueled by the expiration of the 2 percentage point cut in payroll taxes, the Conference Board reported Tuesday.
The tax increase took effect on Jan. 1, and though long expected in Washington, it appeared to take consumers by surprise. It was included in the $650 billion 'fiscal cliff' tax package passed by Congress in the early morning hours on New Year's Day. The bill was dubbed by the media as a 'tax hike on the rich, ' but the payroll tax provision hit the paychecks of primarily middle- and low-income consumers.
'The increase in the payroll tax has undoubtedly dampened consumers' spirits and it may take a while for confidence to rebound and consumers to recover from their initial paycheck shock, ' said Lynn Franco, economist at the Conference Board.
The index fell to 58.6 from 66.7 in December. Confidence also slumped in December as Congress and the White House battled over the tax package, spoiling what started out to be a strong Christmas spending season.
In the end, as the din from Washington over the budget and taxes crescendoed in the weeks surrounding Christmas and New Year's Day, consumers withdrew from the malls and the shopping season had a weak finish.
The National Retail Federation said spending rose by only 3 percent during the holidays — an uninspiring performance.
'The holiday season went head-to-head with Washington's political wrangling over fiscal concerns, shifting consumers' spending plans downward, ' said NRF President Matthew Shays.
Mr. Shays said the consumer slump is likely to continue into this year, since the battle over taxes and spending was not resolved at year-end, with Congress postponing the deadline for $100 billion in spending cuts until March.
'What we witnessed during the holiday season is an indication of what we are likely to see in 2013. Consumers read troubling economic headlines every day and look at their bottom lines at the end of the month, and they don't like what they see, ' he said.
'Pushing fiscal policy decisions down the road will lead to even greater uncertainty, and will continue to impact consumers' desire and ability to spend on discretionary items. The administration and Congress need to pursue and enact policies that lead to growth and economic expansion, or it could be another challenging year for retailers and consumers alike. '

Apparently plenty of foreigners do get locked up in the DR too, although I am not sure what for. I was talking to my dentista today, whom I have known for many years, and I commented that her English seems to have improved a bit since I first knew her. She said yes, there were a lot a foreigners at her day job, so she had opportunities to practice. I asked where her day job was, and she said at the castillo (prison.)Not quite sure how or why, it seems anyone with money can buy themselves out of anything there, or maybe that applies only to Dominicans.

agents gathered at the medical-office complex of dr. salomon melgen, a contributor to menendez and other prominent politicians, to start hauling away potential evidence in several vans.
the investigation is believed to be focusing on melgen's finances and the allegations about menendez's trips and contact with prostitutes. a spokesman for menendez could not be reached for comment, nor could melgen.
melgen has an outstanding irs lien of $11.1 million for taxes owed from 2006 to 2009, according to records filed with the palm beach county recorder's office. a previous irs lien for $6.2 million was released in 2011.
despite those financial problems, melgen and his family have contributed at least $357,000 to candidates and committees since 1998, according to florida and federal campaign records. of that, the melgens have contributed about 9 percent to menendez's federal campaigns.
melgen also owns a private cl-600 challenger plane through one of his west palm beach-based companies, and frequently flies between south florida and casa de campo in the dominican republic, where he is from.
menendez has flown on the plane at least once, his office has said, when he was chairman of the democratic senatorial campaign committee from 2009 to 2011, when the melgens contributed about $60,400 to the group. a spokeswoman had previously said that menendez and melgen are longtime friends and said the senator did nothing improper.
melgen was first linked to menendez just before the november elections, when the conservative daily caller website interviewed two alleged prostitutes who said they had relations with the new jersey democrat at melgen's dominican republic mansion in casa de campo.
after the election, the news died down.
but then, days before menendez was about to start leading the senate foreign relations committee as chairman, reporters started receiving a 58-page dossier of emails between a miami fbi agent and a tipster who claimed that some of the prostitutes had been ****.
'i'm not going to respond to the fallacious allegations of your story, ' menendez told the daily caller on monday when a reporter caught up with him on a train in washington.
at the time, menendez had just stepped into the national spotlight along with sen. marco rubio, r-fla, and six other senators who are hammering out a highly watched immigration plan that is the talk of washington.
rubio is one of the few big-name florida politicians who has not received campaign money from the melgens, who have contributed to sen. bill nelson and reps. debbie wasserman schultz, joe garcia, ileana ros-lehtinen and mario diaz-balart, among others.
the fbi would not comment on the emails, and the agent, regino chavez, did not return calls or emails. but sources familiar with the investigation told the miami herald that the emails are real.
the emails from agent chavez show that he tried to find out what happened. but the tipster, who went by the name 'peter williams, ' refused to talk to him by telephone or meet him face to face.
chavez contacted the tipster aug. 1,2012, after the group citizens for responsibility and ethics in washington referred the case to the fbi. the tipster would not meet or speak by phone to crew or to an investigative reporter, either.
'as far as the information you have provided, we have been able to confirm most of it, ' chavez wrote on sept. 12. 'we know that you are providing accurate information. '
but it is not clear what that specific information is because chavez was unable to interview the alleged prostitutes. over the months, chavez tried to meet or speak with the tipster, but had no luck.
then, on nov. 1, the agent wrote the tipster again and drew attention to the daily caller interview with the alleged prostitutes.
'i think we are at the point where you and i need to communicate over the phone so that we can move faster, ' he wrote.
no luck.
amid the suspicious circumstances of the complaints, democrats have tried to characterize the reports about menendez and melgen as a right-wing smear job.
senate democratic leader harry reid refused to comment on the possibility of an fbi investigation when he was asked tuesday about the case.
said reid: 'always consider the source. all anyone here has to look at is the source where this comes from. '
tuesday night's raid, however, shows that there is at least an investigation tied to menendez's longtime friend and ally.

'that senator also likes the youngest and newest girls, ' the woman wrote on april 21, 2012, according to an english translation provided to the daily caller by a native spanish speaker.

thedc is not disclosing the woman's name because she may have been a minor when her alleged sexual encounters with menendez occurred. four different spanish speakers who reviewed thedc's translation of her letter all said her spanish writing indicated someone who was very young and unsophisticated.

that young prostitute said she had sex with menendez 'three times at least' in 2009. 'the first one in february, and then in may and june. i recall his visit in june so well because that month was my 17th birthday. '
the woman whose email crew released on wednesday also recalled a sexual encounter with menendez near her birthday, but said hers was in a different month.

This "New Sosua" is starting to remind me of Costa Rica in so many ways, and thats scary. I've been to CR once and that was one time more than I should have gone. CR has the Delrey, HLH, Sportsman and more of the same spots where there are bars and women hanging out near hotels. The girls work on an hourly clock. They say "cien" before they say their name. None of these venues have clubs for dancing. The girls are unionized and guys overpay. This "New Sosua" is starting to remind me of Costa Rica in so many ways, and thats scary. I've been to CR once and that was one time more than I should have gone. CR has the Delrey, HLH, Sportsman and more of the same spots where there are bars and women hanging out near hotels. The girls work on an hourly clock. They say "cien" before they say their name. None of these venues have clubs for dancing. The girls are unionized and guys overpay. Sosua hasnt gotten to the point where they ask for cash up front and mostly do CBJ like CR, but I feel that is next. CR doesn't have many young guys, could this model be coming to the "New Sosua"?
I really don't think the Dominicans have a master plan, they just are sucking in the" New Money" until the next buisiness owner comes. Lets see: Latinos has changed owners and names 3 times in the last year, Club X had a grand opening then closed, the bar across from NG closed, Cuba libre bar has new owner, Classicos, Merengue etc. None of these new spots have dancing. Basically Sosua has been reduced to sitting at a bar and then fucking a girl for an hour and she beats you back to the bar. After one has a dance floor but it is also the only place open after 3am. I used to love disco hopping in Sosua. Start at Latinos hit Classicos then Club X then After one. It was something about the sexual energy of people dancing together and visually fucking with clothes on that will be missed. It also allowed the girls the chance to seduce their prey for an all-night fuck session. But these new "bar girls" arent doing TLN and don't want an after TLN breakfast. Damn! I remember when guys and girls were proud to have a goodbye breakfast to seal the deal. I remember when girls would wait in the hotel room while I bar hopped. I remember girls wanting you to have dinner with her family to show off her new boyfriend. I remember when Classicos had one night pros looking for their prince.

BOCA CHICA, Dominican Republic. By day, Italian tourists pack the beach of this Caribbean seafront village. By night, prostitutes fill its streets.
'Prostitution is everywhere here; on the beach, in the bars, in the clubs, ' said Antonio Guzman. 36, a hustler who has worked the beach for 15 years and regularly connects tourists with prostitutes. 'This place runs on it. '
On a weekend at midday recently, a few blocks from a beach where hundreds of Europeans tanned, a few middle-age men entered a small club on a quiet street. Inside, they had their choice of pretty, young, mostly Dominican women: $50 bought them two hours in a private room with the girl of their choice, drinks and food, the men said.
Across this nation of 10 million, similar scenes play out — from small bars and hotels where tourists pay $40 for a half hour with a woman to packaged sex tourism vacations costing upward of $4, 000 for a three-night, all-inclusive stay.
Long before explosive allegations emerged claiming Sen. Bob Menendez, D-N. J, and a political contributor flew to the country for wild parties with several prostitutes, the Dominican Republic had cemented its reputation as a hub for sex tourism. Menendez has denied the allegations, calling them a political smear campaign.
Studies suggest between 60, 000 and 100, 000 women work in the sex trade in the country, according to the Center for Integral Orientation and Investigation, a health and outreach organization based in the capital, Santo Domingo.
By no means is sex tourism solely the domain of the Dominican Republic. Countries from Costa Rica and Brazil to Thailand and Cambodia have massive industries. But the Dominican Republic's proximity to the United States — less than two hours from Miami by plane — and Europe, coupled with its cheap travel packages, have made it a preferred spot.
'The Dominican Republic has been associated both on the island and off the island with sex for sale, ' said Denise Brennan, a Georgetown University professor and author of What's Love Got to Do With It, which examines sex tourism in the country. 'Dominican sex workers strategically position themselves and talk about themselves and make use of foreigners' expectations of them as being hot and sexy. '
UNDERBELLY.
The country — which attracted 4. 6 million visitors last year, making it the most visited nation in the Caribbean — is well known for its pristine beaches and mega resorts. But in those same tourist areas, it's common to find European or American men with women half their age — a highly visible underbelly of the tourism industry neither emphasized nor condemned by the government and tour promoters.
The tourists who flock here from the United States, Europe and beyond are among the best-paying and most sought-after clients.
'Europeans or gringos, they pay the most and you don't have to deal with the excuses that the Dominican men give you, ' said Odalis Vasquez, a 36-year-old prostitute who each winter travels to a small town on the island's north coast.
There, she stays in a small house where the owners provide her room and board and send her clients, almost all of whom are foreign tourists.
In two weeks, she can earn between $600 and $800. 'It's as much as I make in two months at home, ' which is a small house in Haina, adjacent to Santo Domingo, where she lives with her husband and four children.

she has a day job, but at night, yaneisy said, she can charge upward of $500. she convinces men to come visit for a few days or a week in which she stays at a hotel with them, receives gifts and then payment when they leave.
'i have ads on websites. they contact and we chat, ' she said, explaining how she finds foreigners.
for vasquez, the attraction to the profession is financial. for foreigners, 'i'll do the things that their wives won't do. and then it's done. they never have to see me again if they don't want to, ' she said.

vasquez recalled one of her best-paying clients: a german tourist who had always dreamed of a night with two women and hired vasquez and her friend to make it happen.
'we've become known as a place where foreigners feel they can come and live out their fantasies, ' said jacqueline montero, a former prostitute and now executive director of an organization that assists sex workers. 'it's not illegal. it's easy and, for tourists, it's inexpensive. '
while laws prohibit sex with those **** 18, prostitution is neither illegal nor legal in the dominican republic. and although it is practiced openly and widely accepted as legal by police, the legal gray area leaves women powerless.
'women are left with no rights, and police take advantage of that. they arrest them or harass them for money, ' montero said.
in boca chica, women said the tourism police regularly fleece them. 'they come to you — these are guys that you know and see every day, you know them — and all the sudden they detain you, ' said a 24-year-old woman who goes by orchid. she declined to provide her full name for fear of retribution from police. 'and then you have to pay or someone you know has to pay to get you out. ' that bribe can cost as much as $25, she said.
asked about the allegation, the local tourism police supervisor waived his hand and said he couldn't talk to reporters without the public relations office first clearing it.
for orchid, it wasn't a deterrent. 'tonight, ' she said, scanning a beach of tourists sporting speedos, 'is going to be busy. '

Just be glad we knew the good old days because I think they are gone forever.I just hate that I did not find out about the place prior to 2008. But I did have a good run between '08-'10. I sat out 2011 and after the one (weak) trip in 2012 I haven't returned since.
But after Colombia, it's going to be hard for me to return to an all-puta environment. Sosua is great because you (can) have a lot of hot women concentrated in one area without having to do any leg work on your part (other than walking to the strip). The bad part is that the service is shitty. Like Gogo said, by the time your last drop of leche has hit the bedsheets they are already putting their heels back on and flying out the door (after you've paid them, of course). They don't have to provide good service because she can quickly go and make money with someone else.
You will have a much better experience if you meet chicas outside of an environment like Sosua. The bad thing about the DR is that the Prepago concept is not as strong as it is in South America. If you meet a chica on Dominican Cupid, she thinks you are trying to have a long term relationship with her. As others have stated, most of them live with their parents and if you want to take them out you have to meet them. Ain't nobody got time for that!
All the chicas I have contacted in Colombia are prepagos. They have cell phones and access to email and fb. You make they call, all they want to know is "when" and "where" and will work out "how much" when they arrive. There are no illusions about you looking for a novia. But the flip side is that they will hang with you and fuck you like you are their boyfriend. Plus, they don't expect you to keep in contact with them once you leave. You can just hit them up close to when you are returning or are there on the ground.
I would like to try to make Santo Domingo work for me, but the transportation situation there is all fucked up. Like BBBL said, if you call a chica over, she nor the taxi driver know where they are going, and once she arrives and the taxi driver see's that you are a gringo, he is going to try to juice you because they don't use the meter like in Colombia. If you rent a car in SD you run the risk of getting exploited by the cops, sitting in traffic all day, and if you don't know where you are going or anything about the area, you could end up in a fucked up situation.

DALLAS – After more than a year of talks, a merger between American Airlines and US Airways will likely be announced next week, sources tell News 8.
"The economics make so much sense. They're so compelling that I think the creditors and the boards of both companies said 'let's get this done it will be good for everybody," said Mark Drusch, an executive with Fareportal, who also held high-ranking positions with Continental, Delta and Lufthansa.
The board of directors of AMR Corp, American's parent company, will meet on Monday to consider a combination, News 8 has learned.
Officially, American tells us it does not discuss and will not confirm a board meeting next week.
But it's no secret that both airlines have been swapping financial information over recent months to see if a merger made sense.
Currently at issue is which executive team will lead the new company.
Sources tell News 8 that US Airways CEO Doug Parker will likely take over, and AMR CEO Tom Horton will be given an honorary position on the board such as non-executive chairman.
American's labor unions, which have long pushed for a merger with US Airways, have publicly stated they don't want American's management running the new company.
"Here's the conundrum the board is faced with, ' Drusch explained. 'If the unions are really digging in saying we don't want Horton around the board has to decide 'Is Horton important enough to keep around to potentially suffer labor disharmony through a merger."
Teams from both airlines are currently collaborating on how to make the merger announcement and where it will take place, sources said.
The new company will be based in Fort Worth, but led by the smaller airline, which is currently headquartered in Phoenix. The combined carrier is expected to retain the American Airlines name.
In January, Horton said an announcement about the future of American would be announced soon. The two airlines have been in official talks for months.
Weeks later, American debuted a new logo and paint scheme for its aircraft. At the time, Horton said he did not expect to have to change the livery again if a merger came to fruition.
Drusch predicted fares would increase in the long-term and even if American decides to merge with its smaller rival next week it's doubtful passengers would see any change for months.
The US Airways board would still have to consider a merger, along with creditors, American's bankruptcy judge, the USA Department of Justice and even the European Union before the two companies would ever become one.

Here here. I cringed when United acquired Continental. How are we going to have a free market, where there is no free market. Monopolies should also be a embolden highlight of the 20th century. Auto-industry, Agro-farming, Commercial travel, on and on. I would like to see a return to the competitive market that we all enjoyed as youngsters.
Is southwest the last vestige of competitive domestic travel? These super giants will try to milk us dry if we don't have alternatives.

I would like to try to make Santo Domingo work for me, but the transportation situation there is all fucked up. Like BBBL said, if you call a chica over, she nor the taxi driver know where they are going, and once she arrives and the taxi driver see's that you are a gringo, he is going to try to juice you because they don't use the meter like in Colombia. If you rent a car in SD you run the risk of getting exploited by the cops, sitting in traffic all day, and if you don't know where you are going or anything about the area, you could end up in a fucked up situation.I just returned from Santo Domingo last night, and I had a few girls take taxis to my room. I went out and paid the fare with no gringo upcharge. I was on El Conde with my main chica, and I let her negotiate the taxi fare to return to my hotel. A couple of taxis tried to charge more, but we just walked away, and found one that was charging a normal rate. I got cards for a couple of taxi drivers who didn't upcharge. I also found a barber who did very good work on my beard for 180 pesos. Santo Domingo is not that hard, and I had so much fun that I might put off the Medellin trip again.

We have a preset agreement, that according to him is less than he normally charges visitors. Who knows if he is telling the truth or not, but I'm cool with it, and he takes me all over the place. Normally, I would just use him to pick up or drop off chicas, but I had two wingmen with me, and this was their first trip to the DR, so sometimes I let them use him while I did my own thing. This trip confirmed my belief that I roll better solo. In the future, I'm referring all friends / acquaintances to Sosua. LOL

Sosua is even being too nice. I have a friend that I had to drag kicking and screaming to even open the email I sent him that has the link to the Sosua forum on ISG. He still has not even clicked on it yet!
I finally said fuck it and forwarded him the newsletter to Blackbeard's in Puerto Plata and he signed up for their monthly newsletter. Blackbeard's is now where he has his sights set on. I remember in 09 when I took Sabor and Kutha to the bario in Puerto Plata to hang with some chicas I knew. They were humble dudes and we had a ball. When I first started going to DR I thought it to be a good idea to have a chica negotiate prices for me. Wrong! But, then I realized that they are docile because of how the Dominicanos dog them out, so they don't have that take charge savy skill that we and or "our women" have. Some would say sexualize negotiations between themselves and men, as they do in the states (possibly other countries as well). However, the local Dominicanos are virtually inundated with more chicas then they know what to do with, that is to say a local that the local average guy has some style and piazzas about him. Local guy pays nothing for a chica and if he goes to casa he is bang'and for like 200-500 pesos, or a night out of the house and he's going RAW. LOL.
Basically a chica will be hard pressed to be "forward" and or "aggressive", as is often necessary when negotiating. Moreover, she is concerned about being disrespectful and getting disciplined. This is a male dominated society, even when the men are wrong they get away with it.
So, simply stated, I just studied Spanish harder to be able to negotiate fiercely and often just say F*Ck it and walk away, if I can. Good thing about DR someone else is always selling something you want.
Getting the taxi is easy, call them if you can versus hailing them off the street. When you call them you ask the dispatcher. Tell him you need a taxi to go to point B, after you tell him where you are he more than likely hanging-up the phone in your face; however, that is if your not quick to ask "Cuanto es la tarifa (ta-ree-fa) por alla?"With of course a strong local accent.

KINGSTON, Jamaica (AP). Hadi Mezawi has never set foot on the Caribbean island of Dominica, has never seen its rainforests or black-sand beaches. But he's one of its newest citizens.
Without leaving his home in the United Arab Emirates, the Palestinian man recently received a brand new Dominican passport after sending a roughly $100, 000 contribution to the tropical nation half a world away.
"At the start I was a little worried that it might be a fraud, but the process turned out to be quite smooth and simple. Now, I am a Dominican," said Mezawi, who like many Palestinians had not been recognized as a citizen of any country. That passport will help with travel for his job with a Brazilian food processing company, he said by telephone from Dubai.
Turmoil in the Middle East and North Africa has led to a surge of interest in programs that let investors buy citizenship or residence in countries around the world in return for a healthy contribution or investment. Most are seeking a second passport for hassle-free travel or a ready escape hatch in case things get worse at home.
Nowhere is it easier or faster than in the minuscule Eastern Caribbean nations of Dominica and St. Kitts & Nevis.
It's such a booming business that a Dubai-based company is building a 4-square-mile (10-square-kilometer) community in St. Kitts where investors can buy property and citizenship at the same time. In its first phase, some 375 shareholders will get citizenship by investing $400, 000 each in the project, which is expected to include a 200-room hotel and a mega-yacht marina. Others will get passports for buying one of 50 condominium units.
"The more they fight over there, the more political problems there are, the more applications we get here," said Victor Doche, managing director of another company that offers four condominium projects where approved buyers are granted citizenship in St. Kitts, which is less than twice the size of Washington D. C.
It's impossible to say how many people have used the cash for citizenship programs. Officials in both countries declined to respond when asked by The Associated Press.
"Why do I have to speak on that?" said Levi Peter, Dominica's attorney general."I have no explanation to give to AP."
But Bernard Wiltshire, a former Dominica attorney general, said there were already around 3, 000 economic citizens when he left government about a decade ago. The country now has roughly 73, 000 inhabitants in all.
"Investor visa" or citizenship programs are offered by many nations, including the United States, Canada, Britain and Austria. But the Caribbean countries offer a fast path to citizenship at a very low cost. The whole process, including background checks, can take as little as 90 days in St. Kitts. And there's no need to ever live on the islands, or even visit.
A foreigner can qualify for citizenship in St. Kitts with a $250, 000 donation to a fund for retired sugar workers or with a minimum real estate investment of $400, 000. The minimum contribution in Dominica is $100, 000.
By contrast, a USA program allows visas for a $1 million investment in a USA business employing at least 10 people or $500, 000 in designated economically depressed areas. The investor can apply for permanent residence in two years, and seek citizenship after five more. Demand in Canada is so great that the country stopped accepting new applications in July.
A Dominica passport holder can travel without a visa to more than 50 countries, while a St. Kitts passport provides visa-free travel to 139 countries, including all of the European Union. That's a big deal to people in countries from which travel is restricted or whose passports are treated with suspicion.
Critics say the programs undermine the integrity of national passports and have security risks. While there are no known cases of terrorists using the programs, experts say that's a possibility with many visa arrangements anywhere.
"No level of scrutiny can completely guarantee that terrorists will not make use of these programs, just as background checks cannot eliminate the risk that dangerous individuals will not enter the country (the USA) on tourist visas, as students or as refugees," said Madeleine Sumption, a senior policy analyst at the Washington-based Migration Policy Institute.
Canada imposed visa requirements on Dominica citizens a decade ago after complaining that suspected criminals had used island passports. And in 2010, Britain said it was considering visa requirements for Dominicans, prompting the island to review its 20-year-old economic citizenship program. Dominica never publicly released the results of its review and Britain took no action.
St. Kitts closed its program to Iranians in December 2011, shortly after Iranian students stormed the British Embassy in Tehran. Iranians had earlier been a major source of applicants, according to Doche.
Some locals worry the programs could get out of hand if conditions worsen abroad.
"There could be a flood of people with our passports relocating here," said Dominica's Wiltshire."What are we going to do then? Really, this program must be halted. It's dangerous to us and dangerous for our neighbors."
St. Kitts opposition leader Mark Brantley said the citizenship program was bringing much needed revenue to the debt-swamped islands, but he said there should be better oversight and public accounting."We do not see that sufficient controls are currently in place to ensure that bad people, for want of better language, do not get access to our citizenship," he said.
It's not just economic refugees who are interested in the programs.
American Neil Strauss wrote of securing citizenship in St. Kitts in his 2009 book on survivalist preparedness,"Emergency: This Book Will Save Your Life."
"The same way we have a backup drive for our computer in case the hard drive explodes, I just felt like I wanted a backup citizenship in case the same thing happened to my country," Strauss said during a phone call from his home in Los Angeles. Like most economic citizens of St. Kitts, he rents out his island property.
Some other struggling Eastern Caribbean islands are looking at adopting the St. Kitts model.
Antigua & Barbuda is launching its own citizenship program to drum up money. And leaders of both main parties on the poor island of Grenada have hinted they may revive a program that was suspended after the Sept. 11, 2001, terror attacks, due to fears that local passports could be mistakenly sold to terrorists,
In Dubai, Mezawi said he keeps meeting fellow Dominica passport holders, mostly people of Iranian and Palestinian background.
"After the Arab Spring, it's become more difficult for us to really travel around the world, even in the Arab region," he said."But being a citizen of Dominica, it is much, much better for us."
