THE BUSTING of a highprofile sex ring in south Delhi on Wednesday has once again brought into sharp focus the debate over legalising prostitution in India. Just a couple of days ago, the CBI had warned the Union home ministry of a disturbing child pornography angle to the trafficking crimes in the country.

Five girls and two pimps, said to be the relatives of Delhi's ' Black Widow' Sonu Punjaban, were arrested in the latest incident. The accused were trapped after the police received information about a high- profile gang of call girls working from south Delhi. An Audi A4 car, used by the gang's kingpin to ferry the girls, was also seized after a trap was laid near Qutub Minar.

' Our decoy customer struck a deal with the pimps, Sanjay and Vijay Bhatia, and one of them drove away in his Santro car. Minutes later, he returned in an Audi with two girls and demanded ` 40, 000 and ` 10, 000 for the girls.

When told that the rates were too high, they offered to show him other girls at their Chhatarpur Enclave flat, ' DCP (South) Chhaya Sharma said.

The decoy was then taken to the first- floor flat, where the police swooped down and arrested the two pimps and five girls, including kingpin Nagma Khan alias Abiba. Sources in the police say they had been on the lookout for Nagma since April, when her name cropped up during the interrogation of Sonu Punjaban.

' Punjaban claimed that Nagma was a bigger player and operating on a larger scale. A month ago, we made an unsuccessful attempt to arrest Nagma in Vasant Vihar, ' an officer said.

Nagma was arrested twice in 2006 and declared a proclaimed offender after failing to turn up in the court in connection with a case under the immoral trafficking Act.

During the interrogation of Nagma, a native of Azamgarh whose parents were settled in Saudi Arabia, it came to light that the pimps were Punjaban's cousins. Nagma, who also worked as a sex worker, had been running the racket for the past six years. ' A friend of Sonu Punjaban was helping Nagma get the girls, and her cousins were supplying her with contacts and clients, ' the police officer added.

EFFORTS by the Union government to contain the malaise of flesh trade, meanwhile, haven't met with much success. In this regard, the women and child development (WCD) ministry has been mooting amendments to the immoral traffic prevention Act. 1956, to make it more effective to combat trafficking.

If the changes go through, the sex workers would no longer be charged as accused but treated as victims and the people visiting brothels will be penalised for ' sexual exploitation of trafficked victims'. A ministry official said: ' The police have now been instructed not to book sex workers during raids on the brothels. ' The Durbar Mahila Samanvay Samiti has even filed a PIL in the Calcutta High Court for legalising prostitution. The demand has had the Supreme Court speaking up in its favour, but women's rights activists do not buy the argument.

On December 10, 2009, the SC asked the government whether it could legalise prostitution if it wasn't possible to curb it. ' When you say it is the world's oldest profession and you are not able to curb it with the help of laws, why don't you legalise it? ' justices Dalveer Bhandari and A. K. Patnaik asked the government counsel.

But the issue, as Centre for Social Research director Ranjana Kumari puts it, is that legalisation is a hollow term bandied about by people who don't fully understand its implications. In India, prostitution is not illegal. ' Soliciting sex at a public place and pimping are illegal, ' she says.

' How can you legalise an activity in which minors are involved and even adult women have no control over their income? ' Legalisation, argue its supporters, can help control medical problems and tackle trafficking because then the women being brought into the country will have to be registered. It may also help keep minors out of the trade.

' Still, legalisation is not the solution, ' All India Democratic Women's Association (AIDWA) general secretary Sudha Sundarraman says, adding: ' Talking about improving the women's economic conditions, we should realise that prostitution is not a profession that women get into by choice. They are pushed into it and hardly anything they earn actually goes to them. ' Kumari says that instead of legalising prostitution, purchasing sex ought to be made a criminal act. ' We need a new law to confront the problem, ' she says.

FIGURING THE SHAME.

According to Unicef, India has half of the one million children worldwide who enter the sex trade each year.

In 2002, the government signed the South Asian Association for Regional Cooperation (SAARC) Convention on Prevention and Combating Trafficking in Women and Children for Prostitution.

India acts as a source, transit point, and destination for many thousands of trafficked women. There was a growing pattern of trafficking in child prostitutes from Nepal and from Bangladesh (6, 000 to 10, 000 annually from each).

Girls as young as seven years of age were trafficked from economically depressed neighbourhoods in Nepal, Bangladesh, and rural areas to the major prostitution centers of Mumbai, Kolkata, and New Delhi.

According to NGOs estimate that there were approximately 1, 00, 000 to 2, 00, 000 women and girls working in brothels in Mumbai and 40, 000 to 1, 00, 000 in Kolkata[/quote]

IN SOME countries, prostitution is legal and regulated, though activities such as pimping and street- walking are generally illegal. The degree of regulation varies by country, for example, not all countries require mandatory health checks. These checks are seen as too intrusive, a violation of human rights and discriminatory, since the clients aren't subjected to them.

In some of these places, the regulations are tight, (e. G, Nevada) , while at other places (e. G, New Zealand) they are loosely regulated.
