I think you need to argue over the "deemed" clause.[/QUOTE]Yep, there it is as usual; the necessary tangential issue or qualifier that provides a legal reason for the police to arrest, round up, herd, sweep or whatever terms are preferred, Sex Workers for something vaguely related to prostitution but, mysteriously, never for the actual act of consenting adults exchanging sex for money. This time they pulled out the old "open, shameful or disturbing to the public" premise.

I suppose we could sometimes replace the words "disturbing to the public" with "disturbing to nearby competitor Sex For Pay venues" like bars, massage shops, gentleman's clubs and so on. Especially those for which the "sex in exchange for money" part requires paying a barfine, expecting the customer to buy ladydrinks, renting an on-bar-premises room and so on that are not required or expected with street girl sex. Why, one would think the police and legal authorities know there is nothing in the books, in The Thai Penal Code, The Prostitution Prevention and Suppression Act or anywhere else that gives them the legal power to arrest, charge or drag through a court case any consenting adults, foreign or domestic, who agree to, are about to or already have exchanged sex for money. And that is apparently even more certain for the customers or potential customers since we read nary a report about so much as one of them being tossed into those round ups, arrested and charged with anything.

But, you're right, the only question that is never fully answered with these "disturbing the peace" type tangential issues and qualifiers arrests is how does one define "deemed" in the eyes and ears of the police.

Maybe a general rule of thumb is, at minimum, if the Queen was standing on the street within a a meter of the negotiation and could hear and see enough to make her blush, that would be "deemed" a public disturbance.

It's nice you're open to being wrong. Not a very common trait. However, you're not wrong. There's no such sentence / phrase. First, because it just isn't in the Act. But also, logically it can't exist.

There is a saying- The exception that proves the rule.

On one street there are signs that say No Parking.

On the next street are signs saying No Parking On Tuesday.

On the first street, the rule is clear- no parking.

On the second street the rule is clear, but unsaid- parking is allowed. Tuesday is the exception. Otherwise, why not have a No Parking sign?

Section 5 of the Prevention and Suppression of Prostitution Act prohibits public solicitation for prostitution in a manner deemed "open, shameful, or disturbing to the public. ".

Here, although unsaid, the rule is- prostitution is legal. However, there are exceptions- except in a manner deemed open, shameful, etc. And there are other exceptions. Quite a few in fact. But they are all exceptions to what? To legal prostitution. Otherwise, why not just say- prostitution in illegal in Thailand?

From the Thai Narcotics Act be. E. 2545 (2002) "No person shall import / export narcotics of category II, unless obtained the license from the licensing authority for specific cases in government service".

There it is. Very straightforward.

The Thai legislature can write very succinct laws. They can also write very convoluted laws. I imagine they have good reasons for each.

If they wanted to outlaw prostitution in the Kingdom, they would have said just that. Like when they wanted to prohibit bringing in Category II narcotics in, they said just that. Nothing about what manner they were brought in, whether it offended the public, whether it was done openly and on and on. You cannot bring category II narcotics into Thailand without the proper authorization. End of the story. So if prostitution in and of itself is illegal, why didn't the government just say so?
