BTW, just a general note to all, offering and paying money for sex to anyone under the age of 18 is illegal in Thailand. The issue regarding barfines would be it is legal for the bar to charge a fee to take a girl out of the bar during her regular work hours.
However, it is illegal for the mamasan, bar management or bar owners to profit in any way from the exchange of money for sex with the girl. That exchange is legal in Thailand only between the girl and her customer. It is illegal for anyone else, a third party, pimp, mamasan, agency, parent, boyfriend, whoever, to profit from the exchange.
So that is where the mamasan and the bar are taking a risk in demanding ALL of the money for the girl to have sex with a customer be paid to them upfront in the bar rather than just the barfine.
Aside from the demand probably having something to do with the mamasan wanting to rake off her 500 - 1000 baht commission right now before the girl disappears into the night perhaps never to return again, it strongly suggests the bar has a financial stake in their girls having sex for money, which would be illegal for the bar, not for the girl or the customer.
When cops raid the bars or agencies, they don't arrest the customers or the girls for "prostitution crimes. " For them, they really haven't committed a "prostitution crime" regarding the simple exchange of money for sex unless there is a criminal co-factor regarding age or coercion. They arrest the mamasans or bar owners for suspicion of them profiting from the exchange, which is a "prostitution crime. ".
