Merely "having" classified documents in a storage box is not a crime. That is why they don't use the word "had" as a point in the law. The word "retain" is the one they use and for a reason. "Retaining" them (please see the extensive definition of the word I provided previously) despite a request by the National Archives and an issued subpoena to return them was the crime Trump committed but Biden did not. And neither did Obama, Clinton or anyone else who left the Executive Branch with dozens of boxes full of thousands of documents packed by staffers, a tiny portion of which might have turned out to have still been classified. For them, no crime. For Trump, crime.
