Section 497 of the IPC says that any man who has sexual intercourse with the wife of another man, without the consent of her husband, shall be held liable for the crime of adultery. However, it does not permit women to prosecute an adulterous husband or the woman with whom the husband has indulged in sexual intercourse. The adulterous woman's husband, thus, alone has the right to prosecute the "adulterer. ".
The above law is really preposterous and can arrest the man and imprison for 5 years.

Does it not then stand to reason, that there is no offense if one has sexual intercourse with a woman whose husband consents to such intercourse?

Yes, section 497 of IPC is the one of the prime example of our absurd Victorian era laws. There's actually a hearing going on in Supreme court and Supreme court is considering scrapping this law. I hope this happens.

The way it looks, it is better the law remains. In this very forum there was a few years ago a husband providing his wife. Some seniors might remember. Even now, we have this couple from Nasik who periodically come to Mumbai after earlier negotiations & amount settled. At least one is sure that husband consenting keeps the law away.
