Group Sex in Thailand: Legal or Illegal? Sex Party Busted?
29 busted, massive fine threatened after Pattaya sex party
Banglamung District officials and Pattaya police stormed the Ban Tulip Hotel April 21, finding 14 couples having group sex and exchanging partners during the swingers party they paid 1,500 baht each to attend. A reminder to all International Tricks that Defamation in Thailand IS illegal?
In plain language and without question.
Everyone can already see why you are so adamant to find out where my dick has been regarding P4 P, what I might have learned and can share here about P4 P in Mira Club or somewhere else, what all of us can tell you about where the "hos" engaging in the exchange of sex for money can be found and on and on.
Exactly what was your problem with my post about Mira the club that I actually provided information on my experience when I went into to the club, but you were looking at the club from the outside and watching YouTube videos about it?
Do you have any proof that I have ever did this?
I would also suggest anyone else on this ISG Forum to be very, very cautious about sharing positive info about those things here as well. Unless you don't mind anti non-criminal prostitution zealots like SubCmdr using that information to continue doing what he has time and time again proven himself to be driven to do; to alert the authorities publicly here and possibly privately as well that he sees it as "not legal", effectively lodging a complaint and joining every other such zealots out there to demand the Thai police investistigate, monitor and potentially shut it down even if they eventually never find a law that has been broken.
Maybe you didn't understand me when I posted information on: Sections 326-333.
Defamation in Thailand is primarily governed by Sections 326-333 of the Thai Criminal Code, which criminalize acts that impair another person's reputation. Section 326 defines basic defamation as imputing anything to a third person in a manner likely to expose the victim to hatred or scorn, punishable by imprisonment of up to one year or a fine of up to 20,000 Baht.
Aggravated defamation, known as Section 328 (Defamation by Publication), applies when the offense is committed via documents, films, broadcasts, or online platforms. This carries heavier penalties of imprisonment not exceeding two years and a fine not exceeding 200,000 Baht.
EihTooms can consider himself informed along with all other International Tricks unfamiliar with the laws in Thailand.
Is that in plain enough language for you!

A few thoughts from The Cmdr
I was going to quit posting. As you have seen I have been taking a withering beat down from Senior Members. They are tapping out, tapping in, ganging up, calling for back up. But then, I got a message from a brother who told me that they had found some of the information I shared outside of the RANTS thread useful and that I should keep up the good work. That was all I needed to realize that there is no information to be found here in the RANTS threads. It my mind it does not serve the purpose of ISG. I will let the pedantic mother fuck quoted it completely and correctly for you.
My real work remains outside of the RANTS thread. Which curiously no one takes issue with the information I am providing about Bangkok and Thailand except for one totally fucked up in the head Senior Member.
We shall go on to the end, we shall fight in France, we shall fight on the seas and oceans, we shall fight with growing confidence and growing strength in the air, we shall defend our Island, whatever the cost may be, we shall fight on the beaches, we shall fight on the landing grounds, we shall fight in the fields and in the streets, we shall fight in the hills; we shall never surrender, and even if, which I do not for a moment believe, this Island or a large part of it were subjugated and starving, then our Empire beyond the seas, armed and guarded by the British Fleet, would carry on the struggle, until, in God's good time, the New World, with all its power and might, steps forth to the rescue and the liberation of the old.

Thanks for another report supporting my contention and not yours

Another report that serves as a perfect example for no arrests "for prostitution", as in the mere exchange of money for sex among consenting adults, and instead for other things. LOL. And you had to go all the way back to 2018 to find it for me.
Thanks:
Police arrested 28 naked foreigners and Thais in a raid of sex party at an illegal hotel in Pattaya.
..........
The hotel, featuring 30 rooms and a play zone spread over a rai of property, has been open for five years, but was never licensed.
..........
Pattaya police have asked Banglamung District Chief Naris Niramaiwong to close the hotel and after calculating the fines and per-day penalties for such an offense, recommend to Chon*buri Province that owner, Chinese national Xeng-chai Yang, 53, be fined 18 million baht.
He also was arrested and additionally faces charges of offering sexual services, public indecency, encouraging public indecency, and operating an illegal sex business.
Staffers were forced to serve the swinging guests hot tea, clean up their mess and even join in the sex games, Naris said.
The district chief added that the hotel had openly advertised its weekend sex parties on the internet, but admitted authorities remained oblivious to it until receiving a complaint.
Yes, as I have warned you before, don't patronize publicly-advertized illegal prostitution establishments, don't force anyone to participate in your prostitution party and don't do your naughty business openly in front of the hotel staff. Oh, and if you are thinking of running a commercial sex for money / prostitution establishment, be prepared to get busted and fined.
However, as you can see in your linked report, you and any other consenting adults who are exchanging sex for money behind closed doors will not get busted for that. Therefore, avoid the prostitution-related violations clearly cited in your report and you and your party have not done anything illegal or a crime in Thailand.
But I've got to ask; did you know that report would only support my contentions about prostitution and refute yours when you found it and posted it or did you just learn about that now?
The fix for that is easy. Stop doing it.
In plain language and without question.

Check Ball!
SubCmdr, if you don't want to be hated and scorned by members of this Forum maybe you should stop defaming, impairing the reputation of and imputing in a manner likely to expose every other member of ISG to hatred and scorn by continually and repeatedly asserting on this online platform that what virtually every one of us post about regarding the mere exchange of money for sex with consenting adults age 18 and older in Thailand "is not legal in Thailand" and therefore makes all of us sex criminals?
Otherwise, you might find yourself the target of a class-action complaint to the authorities for precisely the Sections of the Thai Criminal Code that you have so generously cited and more than once. That's a lot of members here who have admitted to what you continually and repeatedly in post after post try to make a case for the powers that be in Thailand to arrest, charge, prosecute and sentence us for being sex criminals.
Which, if you succeed in your apparent mission to accomplish exactly that, is a hell of a lot more defaming and impairing to the reputation of everyone on this Forum than simply pointing out what you are literally telling the world on this public online platform about us, our behavior and our activities in post after post.
What were those Sections again? Oh yes. Has everyone made a note of that? Keep it handy.
Most senior members post here ain't shit just hos and tricks. But they are Senior!
Bro, I would exchange information with you if I had any. I have only been in Tulips one time to look around. My tour guide says you can make any request as long as you do it privately and discreetly. There was a line up of 8 girls. Two that I liked. But the tour was not over and I much more to see. With the exception of Tulips none of the places I was shown have ever been covered here on ISG. I know this for sure because named searched and I was the first person to mention Mira. Then a senior member has a problem with my post a month after I made it.
Thanks for the facetious reply, hope it made you feel better as you obviously need cheering up. Not sure what I did to offend you but attitudes & replies like yours are perhaps why ISG is losing it's appeal to a huge number of punters. You've made a snap-judgement without knowing ANY of the facts or history. Commenting that it's confusing & annoying is just a personal statement & not some sort of edict that you seem to be implying I'm making.
I have commented plenty of times in the past and share my experiences so it's not like I don't contribute & hope this is a two-way street for the sharing of information, that is what a forum is after all, correct? Secondly please point to where I was expecting a swarm of answers, I clearly didn't / don't. Likewise your comment that you suggest public flogging for insolence is not only infantile & uncalled for but a very bad attempt at humour (stick to you day-job if you have one?
Lastly, this is not my first rodeo & I've been to BKK many times so I know how the system works etc, but I'm older & wiser now & rather than running round BKK (during monsoon season no less) & getting BOTG, I was hoping (obviously incorrectly) that fellow punters may share some basic info that would improve my chances of finding exactly what I'm looking for & allow for a better personal experience. I'm sorry that is such a BIG ask in your opinion.
I am glad you decided to push back. You have nailed it. Senior members have lost what it means to exchange information. Check out the attitude of this Senior member:
Now I am so glad I didn't keep you updated on those specifics here because you have made it abundantly clear in plain language that your mission is to do and say whatever possible to get these "not legal" in your mind activities and participants arrested, indicted, sentenced and shut down even if the law can't find a Citation or Section in any legal document to apply against them. I won't hand you ammunition in this obvious mission of yours. I value the good places and ladies that have facilitated great P4 P experiences for me in Thailand too much.
I would also suggest anyone else on this ISG Forum to be very, very cautious about sharing positive info about those things here as well
So there you have it in plain language. I don't know how other Senior members feel about his statement. But no one else has pushed back against it. I am a senior member and I continue to exchange information. A ISG brother wrote to ask me for the profile names of the new 18 and 19 year olds on Thai Friendly. I sent them to him most ricky tick. They are not my girls just my turn. Some senior members have yet to learn this.
Are you aware WithNailAndI that not a single member of the bar in Thailand has ever given a legal opinion that prostitution in Thailand is legal?
On a personal note: I'll meet any Senior Member at the Bus Bar, in Tree Town, Pattaya, Thailand if they wish to serve me court papers. Not concerned about it because I keep a Thai Attorney on retainer. But you better have your health insurance paid up. Make sure you are not writing a check that your ass can't cash. Because I will have a golf wedge in my hand. I like to practice my short game and afterwards have a drink. That is why I will have it with me.
ROTFLMAO!
The law is not written in plain language!
Those saying Prostitution is Legal in Thailand are making a legally unsound and intellectually dishonest argument. My push back against it has been met with ad hominem attacks and defamatory statements. Let's start a the core:
Prevention And Suppression Of Prostitution Act B.E. 2539 (1996)
Definitions
Section 4
In this Act,
prostitution means sexual intercourse, or any other act, or the commission of any other act in order to gratify the sexual desire of another person in a promiscuous manner in return for earning or any other benefit, irrespective of whether the person who accepts the act and the person who commits the act are of the same sex or not;
prostitution establishment means a place established for prostitution or in which the prostitution is allowed, and shall include a place used for soliciting or procuring another person for prostitution;

Section 5.
Any person who, for the purpose of prostitution, solicits, induces, introduces herself or himself to, follows or importunes a person in a street, public place or any other place, which is committed openly and shamelessly or causes nuisance to the public, shall be liable to a fine not exceeding one thousand Baht.
What does it mean to solicit for prostitution?
Solicitation of prostitution is requesting, agreeing to pay, or negotiating for sexual services in exchange for money or something of value, even if no actual sexual act occurs. *.
Section 5 can apply to the Prostitute or the Trick.
Section 6.
Any person who associates with another person in a prostitution establishment for the purpose of prostitution of oneself or another person shall be liable to imprisonment for a term not exceeding one month or to a fine not exceeding one thousand Baht or to both. If the offence under paragraph one is committed on account of compulsion or under an influence which cannot be avoided or resisted, the offender is not guilty.
What is a prostitution establishment?
prostitution establishment means a place established for prostitution or in which the prostitution is allowed, and shall include a place used for soliciting or procuring another person for prostitution;
That is a pretty wide definition. I can walk out my door and into a prostitution establishment in under five minutes. There is no signage. There are no markings. There are no advertisements. But I know EXACTLY what can be done in the location. And so does everyone else. Including the police. But as it has been established in previous posts I have made, all law enforcement is selective. The same way as the nominee laws are now being selectively enforced.
Section 6 I have been told that this occurs all the time inside of in person venues all over Thailand. Most tricks have a out and so do the prostitutes. It's called ALCOHOL.
If the offence under paragraph one is committed on account of compulsion or under an influence which cannot be avoided or resisted, the offender is not guilty.
I have just covered how prostitution is actually engaged in Thailand. The hypotheticals I have been given are unrealistic. How do I know? Because when I ask for a real example on ISG where prostitution was engaged that was legal, no example could be found or given. If it is as certain Senior Members like to say, then giving an example puts no one in legal jeopardy now does it?
Period! Full Stop!
Did you know that in the entire history of ISG no one has ever produced a legal opinion from a member of the bar that says prostitution is legal in Thailand?
Can we just get over this shit
Sweet Jesus! This is like two ticks arguing over who owns the freaking dog, and this sounds like a two year old ready to take his ball home because he can't be captain of the team.
Different opinions I get, but this argument is functionally pointless. When was the last time some dude got arrested for bar fining a gal from a club?
Can we at least move on to argue about something useful, like the definition of "is?

I quoted the law. I apologize if that offended anyone. I didn't write it the law!
I just quoted the law and offered my opinion (as a lay person). I did not write the law. No one in the history of ISG has ever presented a legal opinion from a member of the bar that prostitution is legal in Thailand. That remains a undisputed fact. How do I know? Because if I was wrong about that someone would have presented it to me by now.
Useful input?
Different opinions I get, but this argument is functionally pointless. I do not have access to all the history or court records in Thailand. I cannot prove the absolute non-existence of this with infinite certainty. Unless you can tell me that you have reviewed those records.
Before the enforcement actions started against nominee structures in Thailand, for nearly 20 years you could have asked the exact same question about those who controlled real assets and businesses using those structures. Talk to the people who have been arrested lately. Let me know what you found out.
How does prostitution actually occur in Thailand?
If you go into a bar. Have a drink with a girl. Make small talk. Then bar fine her. Your hypothetical situation applies. But who does that? Have you ever done that BMoreDog69? You bar fine girls and never have a discussion about prostitution with them?
Definitions

You can either read the law, comprehend the law, interpret the law, and think for yourself. Which is what I choose to do. Or you can let a Senior Member lay person tell you what the law says. I am not trying to do that. I am giving my opinion as a lay person. Everyone is allowed to offer up their opinion as a lay person. You only create a problem for yourself if you are giving advice to others. I am only writing my opinion on how I see the law in Thailand. My opinion holds no dominion over the actions and opinions of another grown man.
Eyes wide open my brother!
It should be noted:
I am just giving my opinion (as a lay person) of the law after I have read it. No one is forced to read or reply to any of my posts. Many have announced they have me on ignore. I thank them for not wasting my time. Since I no longer have to read nonsensical responses from those individuals to my posts.
