Posts: 7973The wording would be blissfully simple and direct. But they are not there.
Do you have a link for that Act or law?

What about private places?
The wording there and in the Thai Penal Code, that does not appear to by shy about covering every angle of P4 P except the central issue, could easily have begun in TITLE IX with something on the order of, "Any exchange of sexual services for money or anything else of monetary value is strictly prohibited and punishable by not more than 1 Billion Baht and Life in Prison without the possibility of parole. ".
And yet no such words appear anywhere in the Code or the Act you referenced. Instead it is all about conducting such business in public, procuring or trafficking prostitutes as a business, living off the profits of a prostitute when you are not the one doing the fucking, sucking or handjobs, setting up an establishment, hanging signs and so on. Aspects of P4 P that have been illegal for a very long time. Those are the things bar owners get busted for, not prostitutes or their customers.
Do you think it was just an oversight, that they forgot to mention the part about a simple private exchange of money for sex between consenting adults being illegal and this is the punishment for it?
If the words I improvised above or anything like them for any level of penalty including 5 Baht and a 2 minute stern lecture were to appear in any Thai Penal Code or additional Act, it would cause a societal earthquake of cataclysmic proportions. It will never happen. Every soi with a hot 19 year old and a 40 year old Thai man with an extra 500 Baht at the end of the month would be awash in criminal activity.
No customer or prostitute of legal age and with their consent is going to be arrested and charged with a crime for which there is no citation in the Penal Code or even in a nice but unenforceable addendum to it.

Posts: 991The key to understanding any law that is published is the vocabulary and the meaning of the vocabulary. Therefore, the law publishes a vocabulary list and the meanings of the vocabulary at the beginning of the ACT. This will answer your question.

In this Act, "prostitution" means sexual intercourse, or any other act, or the commission of any other act in order to gratify the sexual desire of another person in a promiscuous manner in return for earning or any other benefit, irrespective of whether the person who accepts the act and the person who commits the act are of the same sex or not;.
"prostitution establishment" means a place established for prostitution or in which the prostitution is allowed, and shall include a place used for soliciting or procuring another person for prostitution;.
Section 5. Any person who, for the purpose of prostitution, solicits, induces, introduces herself or himself to, follows or importunes a person in a street, public place or any other place, which is committed openly and shamelessly or causes nuisance to the public, shall be liable to a fine not exceeding one thousand Baht.
Section 6. Any person who associates with another person in a prostitution establishment for the purpose of prostitution of oneself or another person shall be liable to imprisonment for a term not exceeding one month or to a fine not exceeding one thousand Baht or to both.
If the offence under paragraph one is committed on account of compulsion or under an influence which cannot be avoided or resisted, the offender is not guilty.
Section 7. Any person who advertises or agrees to advertise, induces or introduces by means of documents or printed matters, or by any means makes known to the public in a manner apparently indicative of importunity or solicitation for the prostitution of oneself or another person shall be liable to imprisonment for a term of six months to two years or to a fine of ten thousand to forty thousand Baht or to both.
Therefore, the definition of prostitution in the Act is clearly defined, so whenever the word "prostitution" is used in this law, it means what it says above. Therefore. Illegal.
Now for the part about the establishment. Any gents club in Pattaya falls under this. Therefore, it's illegal.
If you research the act, there is even a part about advertising. Therefore, if you see a Thai Friendly profile where a girl posts ST / LT and so on. That falls under section 7 above.
Also, if in a private message the girl and you negotiate the cost, that is illegal.
So, in Pattaya, establishments are permitted to operate. Do you know that every bar owner in Pattaya pays a fee to the police every month. I wonder what that fee is for if there is nothing illegal going on.
In closing, you said prostitution is legal. However, the law says it's illegal according to the definition of prostitution in the law. However, you have your own definition of prostitution, which is not relevant as Thailand's definition is: "In this Act, "prostitution" means sexual intercourse, or any other act, or the commission of any other act in order to gratify the sexual desire of another person in a promiscuous manner in return for earning or any other benefit, irrespective of whether the person who accepts the act and the person who commits the act are of the same sex or not;" Therefore, over at your local gents club, after you pay for the room and take your chosen lady upstairs, as soon as you pay her the fee for ST and discuss services, that falls under the definition of "prostitution" in this act and the club itself falls under the definition of "prostitution establishment" according to the act. The club allows it to go on.
The penal code you reference is not the only law that deals with prostitution.. You forgot the PREVENTION AND SUPPRESSION OF PROSTITUTION ACT B.E. 2539 (1996) Why does Thailand have this law if prostitution is legal? Because it's illegal.
We will have to agree to disagree on this one Tooms, but I respect your opinion. You are a valuable forum member. I thoroughly enjoy all your posts and insights. Happy to continue this discussion, but read the law.

Posts: 7973Still no mention in the Thai Penal Code of P4 P being illegal
I have read that "procuring" a sex partner for someone else is illegal in Thailand. And I have read that living off the income of a prostitute in the absence of any other means of support unless that person is the charge or responsibility of support of the prostitute is illegal.

Yes, there is some wording about not forcing or coercing someone yo do whatever against their will or pretending to be someone else and all that.
Nor am I aware of any customer of an over 18 year old prostitute or the prostitute getting arrested and charged for an act of prostitution.
If you or anyone else has a citation for P4 P being illegal in Thailand, please post a link for it.
The section that pertains to it in the Thai Penal Code would be TITLE IX:

Posts: 991This story revolves around a man struggling with schizophrenia, using multiple online personas to navigate a complex world of conflicting thoughts and emotions. His real identity is fragmented into five distinct online characters "1 Drink", "Baj Patel", "Sub Par", "UglyAzzDude", and "Fuckezhov. " Each profile reflects a different facet of his psyche, creating a chaotic yet compelling presence on a sex forum.
"1 Drink" is the self-righteous enforcer, obsessed with ensuring that everyone follows the forum rules. He lashes out at anyone who dares preach about safe sex, believing it's his duty to keep the discussions raw and unfiltered. Yet, within this profile, there's a hidden desperation, a need to control something in his otherwise uncontrollable life.
"Baj Patel" is more diplomatic, often trying to mediate conflicts and soften the harshness of "1 Drink. " However, he's also prone to bouts of anger, especially when his efforts go unappreciated. He's the voice of reason, but even reason has its limits when he's drawn into arguments with his other selves.
"Sub Par" is militaristic, disciplined, and rigid in his views. He's the one who draws lines in the sand, challenging others and defending his positions fiercely. He sees the forum as a battleground, and every debate as a war to be won, even if it means going against his other identities. He does this by meticulously quoting other forum members' posts in and out of context with extreme precision, even taking quotes from one forum category and posting them in other forum categories. This often takes hours as it can't be easy. If he is really in Thailand, how does he have the time to do all this? I mean posting is one thing, but spending hours copying and pasting. How does he have the time?
"UglyAzzDude" is the jester, the one who talks a lot of shit, as he puts it, without any real intention behind his words. He's crude, unapologetically vulgar, and enjoys stirring the pot. Yet, there's a sadness behind his provocations, a deep-seated self-loathing that he masks with humor and obscenity.
"Fuckezhov" is the most enigmatic of the five, often lurking in the shadows, observing the chaos without directly engaging. When he does speak, it's in short, cryptic messages that only add to the confusion. He's the silent observer, the one who watches as the other personas tear each other apart.
One man "Mr. Know it all" claims he has met "Sub Par" That may or may not be true, but if true, it does not prove "Sub Par" is not posting under 5 different profiles. It only proves that he met the dude.
As the man's mental state deteriorates, the boundaries between these identities blur. He begins to argue with himself openly on the forum, with each persona taking a different stance. The other members are confused, trying to make sense of the increasingly bizarre interactions. They grow frustrated as "Sub Par" calls them "Sons' of bitches" with no provocation, and even more so when "Baj Patel" tries to smooth things over, only for "1 Drink" to escalate the situation further.
The forum becomes a chaotic theater of his mind, with his personas clashing, reconciling, and then clashing again. The members, once entertained by his antics, begin to realize that something is seriously wrong. They're no longer sure if they're arguing with one person or five, and the constant name-calling and erratic behavior start to wear thin.
Finally, he admits it all, he confesses that he's behind all five profiles, and that he's been arguing with himself the entire time. He tries to laugh it off, saying he talks a lot of shit and doesn't mean any harm, but the damage is done. The forum members, once indifferent or amused, now react with concern and anger. They call him out, telling him that he needs help, not a platform to unravel.
Realizing he's lost the control he thought he had, he lashes out one last time, calling everyone "Sons' of bitches" before disappearing from the forum. The other members, shaken and unsure how to feel, discuss the situation amongst themselves. They agree that the best place for him is not in the forum, but in a psych ward, where he can get the help he so clearly needs.
In the end, his absence leaves a void on the forum, but also a sense of relief. The chaos he brought, once entertaining, had turned dark and troubling. The members move on, but the memory of the man with five faces lingers, a stark reminder of the fragile line between sanity and madness.
One good thing that came out of all this is the man learnt how to spell. Before he left, "Sub Par" started to correct his posts by ending all his posts with the following: "Do you like me now?"
instead of "Do you like me know?"

Posts: 519What if he is fat, bald, short, and ugly? You're not the gatekeeper of prostitution. And age doesn't mean anything. I know plenty of women, WGs and non-WGs, who won't go with certain types of men. Whether they're paying for sex or not.

He has every right to pay for sex, and age means nothing about who you can or can't attract. There are guys in their 60s who look better than guy in their 20s.
Correct, although I wouldn't use the word “allow” as the police have closed and raided many bars. I would say they “tolerate” it and “understand” that many sex workers are just trying to make money and help family. And it brings tourism.

Posts: 291I never talked shift about nobody I was simply suggesting a better alternative. His age is an advantaged that he can leverage to get young, clean, low mileage, middle class, college student for free in the philippines. I used to travel exclusively to the philippines since I was 21 years old and now I'm in my 30's. After covid thailand allowed travel before the philippines and that's when I started travlling to Thailand twice a year. I truly believe for what that young man is looking for the philippines is the right move.

Posts: 2125My response to the safe sex police
Whether he is wrong or right that is irrelevant. The rules of the forum clearly state that safe sex topics and issues are to be discussed in the safe sex thread not the reports thread. Perhaps guys like you and pimpampumpipo are the morons because you cannot seem to be able to comprehend the rules of the forum and follow them.

And last but not least, it is everyone's own decision to decide what risk level they are willing to take and what precautions they want to utilize or not (condoms, vaccines, prep, doxy, etc.) and it is the personal choice between the two consenting adults whether or not they decide to use or forego the use of condoms. We don't need safe sex police trying to preach down out necks on ISG your advice is falling on deaf ears.

This is the Pattaya Reports thread. That means information related to activities in Pattaya. Out of respect to each other and those who wish to use this thread a reference for information on having sex with girls in Pattaya please respect the posting conventions here. If you want to debate safe sex practices in Thailand there is a thread for that.
A trip report that includes the services received is appropriate and sought out after information for readers of this thread. Just because you do not approve or take part in the service does not give you the right to lecture grown men over how to spend their hard earned money. Make a note: BBFS means Bare Back Full Service. It is a service. In order to receive this service it has to be offered by the prostitute you wish to hire and you have to pay for it. Some want this service. Who are you to tell others they should not use their money how they choose to. Remember, the prostitutes are offering this service and at times charging extra for it. Do you lecture your prostitutes in the same way?
I don't pay to eat pussy I think it called lapping up the cum of others and abbreviated by the quaint acronym: DATY. I don't pay for that shit. That is a personal preference. But I won't do what you did in your post and that is to say others should not do it and pay for it if that is one of the social / sexual services they like to participate in with the prostitutes they hire.
Your posting history
A brief review of your last ten posts show that they have mostly been critical of the posts of others. I do not see a single post where you are providing any information about having sex with girls. Now I talk a lot of shit, but if you look at my last 10 posts there is a least one with a detailed report on a venue here in Pattaya. I'll wait for yours.
How you like me now?

Posts: 368Inappropriate and too often incorrect use of antibiotics
Sorry but you should know that the inappropriate and too often incorrect use of antibiotics has contributed to the development and spread of bacteria that have become resistant to antibiotics. This resistance develops when a bacterium transforms and develops defense mechanisms, reducing or canceling the action of the antibiotics that fight it.
