Posts: 7973Was your A. I. Summary written by someone who passed the Thai bar?
Your A. I. Summary links to the same Thai Penal Code I have linked to countless times and from which no one can find a sentence in any paragraph of any Section that states Prostitution between consenting adults to be a crime or punishable by any penalty whatsoever. So I have no idea what the non Thai bar exam graduates that compiled that A. I. Summary mean by "illegal" or "technically illegal. " Do you? Possibly they mean it the same way I have suggested it means similar to Smiling While Driving not being "legal" because, after all, the Thai government has made no effort to "legalize" it. Which, of course, is an irrelevant point with regard to this hobby or punters and mongers on this site.

Weirdly, even that link only provides a pdf file to download and read. But the Abstract/Citation of it clearly supports my position on it until or unless someone does finally unearth a heretofore undiscovered by Judge, Attorney, Police or anyone else "gotcha" that neither your A. I. Summary nor the linked Thai Penal Code nor the PSP Act state.
Prevention and Suppression of Prostitution Act, be. E. 2539 (1996).
http://<a href="http://<a href="http...46403</a></a>.
If my copy and paste of the above source for the PSP Act does not work, please go to the SubCmder post I quoted and tap on it there. For whatever reason Thailand has made accessing that Act and freely sharing the pertinent Sections, paragraphs and whole sentences of it a major challenge. In this case I copy and pasted the link to it as SubCmdr posted it and it went through a strange transformation into a non working link. LOL.Abstract / Citation
Prohibits prostitution, both male and female, in public places and brothels, and sets penalty for offering sexual services at a fine of 1000 Baht. Also prohibits advertisement for and procurement of prostitutes as well as ownership or management of brothels. Penalizes persons who conduct sexual relations with a prostitute under 18 years of age with imprisonment of up to 2 years; if the prostitute is a child less than 15, the term of imprisonment shall be up to 6 years. Procurement of prostitutes under the age of 18, including by owners of brothels, parents and legal guardians, shall be punishable with up to 20 years of imprisonment. If parents or legal guardians are party to procurement of a child prostitute, a court may also withrdraw legal custody of the child. Persons who force another person into prostitution through violence or intimidation shall be punishable with up to 20 years of imprisonment; if such actions result in injury or death, punishment shall be life imprisonment or execution. The Act also establishes a Committee for Protection and Development of Occupation (P. The. O.) which shall prescribe and implement policies for the eradication of prostitution. Also provides for the establishment of rehabilitation institutions known as the Place for First Receiving, and the Place for Protection and Development of Occupation. The Place for First Receiving shall receive persons convicted for prostitution and assess their mental and physical health, as well as their aptitudes. Convicted prostitutes may then be sentenced to the Place for Protection and Development, which shall provide occupational training and rehabilitation. Repeals the Prostitution Suppression Act, be. E. 2503.
But no matter. I was still able to copy and paste the Abstract / Citation of it here before it went through its transformation, as you can see.
And as you can also see, there is no "gotcha" that makes what we and our P4 P ladies do in terms of exchanging money for sex and sex for money with consenting adults over the age of 18 in Thailand subject to arrest, a crime or punishable by any penalty whatsoever.

Which Section 6 are you referring to and where?

The pertinent selections in the Prevention and Suppression of Prostitution Act of 1996 is where a Section 6 can be found. This is where being able to select, copy and paste individual Sections, paragraphs and sentences would come in handy. But Thailand in its wisdom has only seen fit to offer that Act in a pdf file where that option is either not available on Android devices or, frankly, a process too complicated on an Android device for me to bother.
However, I have included a screenshot below of the page where Section 6 appears. Again. I have zoomed in and read it. I have typed out what it says. I don't see where it says what you say it says:
Now, perhaps you meant Section 8, where the "concept" of your point is addressed but the critical qualifier words and meaning that I have included almost every time, between consenting adults, is missing in your quote but very much present in Section 8 of the Act, if that is the Section to which you were referring.Section 6
Any person who associates with another person in a prostitution establishment for the purpose of prostitution of oneself or another person shall be liable to imprisonment for a term not exceeding one month or to a fine not exceeding one thousand Baht or to both.
If the offence under paragraph one is committed on account of compulsion or under an influence which cannot be avoided or resisted, the offender is not guilty.
The missing words in your quote;.
"against a person over fifteen but not over eighteen years of age in a prostitution establishment"
Then, not surprisingly, it goes on to cite an even greater penalty for committing that crime against someone "not over fifteen years of age. ".
However, you see what is missing in both of those Sections though, right? Yep. If you guessed any reference at all to a crime being committed or a penalty levied if the sex occurs with someone over the age of eighteen, even in an otherwise forbidden "prostitution establishment", then you are certainly right about that, Sir!
Otherwise, nope. Close, but no cigar. Well, actually not even close. But any cigar you smoke at this point you will have to buy for yourself.
Is there perhaps another Section in another Code or Act that you can link here and quote from in its entirety or at least the whole sentence where you saw that alleged "gotcha"?

They are actually not my words. But they words from a respected law firm in Thailand: Siam Legal.
In light of the evolving legal landscape surrounding prostitution in Thailand, it is advisable to exercise caution before participating in any activities related to the sex industry in the country.

Posts: 77I compared Thailand and Spain (asking wether prostitution was legal or not in both of them). Even though the answers were almost identical (only difference between brothels being "sold" as restaurants, pubs or hotels in Spain while in Thailand we all know there are no brothels per se), the considerations were different. In Spain it is a legal (neither illegal nor legal), while in Thailand it is technically illegal (it also says that the act of trading sex for money is not strictly outlawed on its own). So, it is illegal, but there is no punishment for prostitution (maybe because there is no a legal form in Thailand). There are punishments for pimping, underaged prostitution, brothels and public solicitation (openly and shamelessly).

You cannot quote a single member of the bar in Thailand, nor produce a single legal opinion that says Prostitution is Legal Thailand.

But individuals who have studied the law for years and taken a test to join the bar in Thailand do not agree with you. Neither do I. Neither do several other posters that have commented about the issue.

Posts: 86Why don't you read these exchanges with more comprehension. If you did then you'd know that no matter how many PT33's I have I still can't buy edibles legally since under Thai law enacted last year they are a Category 5 narcotic. There's an amazing new invention you evidently haven't heard of called Google where you can pull these laws up yourself so I don't have to keep feeding them to you.

Why don't you produce a legal opinion from a member of the bar of Thailand that supports your position?

https://www.thethailandlife.com/prostitution-thailandProstitution is illegal in Thailand, though the industry is widely tolerated and visible in many areas.
Legal Status: The 1996 Prevention and Suppression of Prostitution Act prohibits public solicitation, brothel keeping, and profiting from prostitution. However, the act of selling sex in private is not explicitly criminalized under Thai law.
Penalties: Individuals soliciting sex can face fines up to 1,000 baht, while pimps and brothel owners face imprisonment of one to ten years and heavier fines.
Recent Developments: A Sex Workers Protection Bill was drafted in March 2023 to decriminalize consensual adult sex work and provide labor protections, but as of August 2026, it has not yet been passed into law.
Enforcement: While technically illegal, enforcement is often inconsistent, with authorities frequently turning a blind eye in tourist-heavy areas like Pattaya and Bangkok, although crackdowns do occur.

19 words.
If prostitution itself is illegal, why does it take an act that is 16 pages and 45 sections long to state that?
The answer is simple.
