Posts: 6804This is the Rants thread so guys can come on this thread to say whatever they want. Many guys will just block posters they don't want to "listen" to any longer so that's always an option. I just choose to read this thread on rare occasions and when I read it it's really just skimming.

The civil suit would follow your conviction for the crime. And I prefer to file that one individually anyway because I'm sure my Thai attorney could get a much better settlement or adjudicated punitive award from you for pain and suffering than any one of us could as a group.

Why do you simply refuse to read and comprehend the plain language in the links and quotes you provide that totally refute your own arguments? LOL.

From your 2023 report link and your very own quote from it:Police proudly declared that, following checks on the famous red light district, they found absolutely no evidence of prostitution.
1. It is the evidence of prostitution the police are looking to suppress. Remember the Act's definition of prostitution being "in a promiscuous manner"?Pattaya Tourist Police were satisfied after finding no illegal prostitutes during yesterdays tour around risky spots.
The inspection, which aimed to stifle illegal prostitution and came after complaints from concerned citizens claiming prostitutes were operating in Pattaya
2. The police outright qualify, literally and in the plainest language posdible, that they are looking for the illegal versions of prostitution. Please refer to 1 above, along with age-related versions of it, venues with sex acts for sale signs outside, ladies shouting their sexual services and prices to passersby, etc. They do not say they are looking for the versions of prostitution that do not conform to the plain language definition of it in the Act and for which there is no Section citing it as a crime punishable by anything whatsoever, such as the mere exchange of money for sex or sex for money between consenting adults that is NOT done "in a promiscuous manner" or "openly and shamelessly in a public place causing a nuisance to the public. ".
Your May 2018 linked report about a sex party cited NO case of anyone there being arrested or fined for the non criminal version of prostitution even after the police sting came up with evidence of sex in exchange for money being offered to them. It only cited late night house violations, running a hotel without a license violations, foreign worker violations, forcing staff to engage in sex acts violations, performing the sex in front of the hotel staff violations, the owner running the venue as a prostitute establishment as proven by his online ads for exactly that violations, the owner taking a cut of the prostitutes' money because it was deposited directly into his personal bank account violations and so on.
All of those prostitution-related behaviors are specifically cited in plain language in the Code and / or the Act as crimes punishable by fine and / or imprisonment.
There was no indication in that report that any consenting adult was arrested or charged for the mere exchange of sex for money or money for sex at that party. Because there is no Citation or Section in the Code or Act that defines that as a crime according to their plain language definition of it that has been repeated to you here and elsewhere numerous times.
And no rogue cop at the scene or any scene can spin off on his own to "selectively enforce" a law that doesn't exist in the Thai Penal Code or the Act, has never existed and will never exist.
As far as your misunderstanding of what constitutes a "prostitution establishment" according to the plain language definition of it in the Code and / or the Act goes, perhaps the simplest way to possibly help you to finally grasp the concept is to compare the way a weed shop sells and allows the sale of weed to happen inside the shop vs whatever individual decision might be made by somebody in a gogo bar, beer bar, night club etc to consent to the exchange of sex for money and convene to private quarters to fulfill that agreement.
1. If you have the proper medical document, anybody and everybody with the money will be able to buy weed in a weed shop as is clearly advertised outside the shop.
2. There is generally no such promise made by any sign or public declaration "in a promiscuous manner" about exchanging money for sex at a gogo bar, beer bar, nightclub or massage shop. It would be a crime if they did that. There is also no assurance that anybody and everybody will be offered or allowed to agree to exchange money for sex in such a venue. Some of those venues and staff go further to make it clear that their staff is there only for you to buy drinks for them and to keep you company while you drink yours. And in all of them it is up to the individuals whether the notion of offering or agreeing to the exchange of money for sex will be done or acted upon, virtually always only discussed, agreed upon and allowed privately between the consenting adults, not involving the owners or management at all and fulfilled away from the public in private quarters.
That is even moreso in venues where the only exchange of money is done or known to be done or allowed to be done by the proprietors is the money given to them to allow a member of their staff to leave their job in the bar for a while. Whatever happens between you and the staff member then is up to you, the staff member and no one else.
See how different that is from what you insist fits the definition of a "prostitution establishment" as defined in the Code or Act?

First, you guys are adults, and you, more or less, "own this place", and as such are free to continue as you see fit. As far as any of this, I am just a gnat on an elephant's ass. My main comment is that what could be an otherwise excellent discussion is, IMO, sidelined my some rather childish remarks.
And for the record, even at my slightly ripe, moderately old, age, I have never been accused of being particularly mature. If that were the case, I would have avoided this thread completely.
Unfortunately, my upcoming fall trip now looks like a spring trip, so I am trying to soothe my butt hurt by reading about all the excellent pussy, until I can get my ass there and act like a proper degenerate in person.
Stay safe, have fun and "flame on!

Impossible to arrest someone for prostitution when there are not prostitutes to be found. ROTFLMAO! The answer to your question is what exactly what I told you before. There is no violation for doing a bar fine. But, the devil is in the details.
Section 4.
In this Act,
prostitution means sexual intercourse, or any other act, or the commission of any other act in order to gratify the sexual desire of another person in a promiscuous manner in return for earning or any other benefit, irrespective of whether the person who accepts the act and the person who commits the act are of the same sex or not;
prostitution establishment means a place established for prostitution or in which the prostitution is allowed, and shall include a place used for soliciting or procuring another person for prostitution;BMoreDog69? You bar fine girls and never have a discussion about prostitution with them? You never answered my question and neither has another senior member either.

Solicitation of prostitution: is requesting, agreeing to pay, or negotiating for sexual services in exchange for money or something of value, even if no actual sexual act occurs.
So I ask again, do you simply walk into a bar in Thailand and bar fine a girl without soliciting her for prostitution?
Prostitution is different from solicitation It is right there in the law. Posted by another senior member and myself.
Enforcement is selective Are you going to tell me with a straight face that there is no prostitution on Walking Street. If prostitution is legal in Thailand why are the Thai Royal Police looking for it in the first place?
prostitution establishment means a place established for prostitution or in which the prostitution is allowed, and shall include a place used for soliciting or procuring another person for prostitution; The statement above is incorrect. Here is an example:Even in a bar or club, an incident of solicitation for prostitution according to the very narrow definition of prostitution in that Act is virtually impossible to prove. If a police sting caught a lady literally telling the cop she will blow him for 2,000 baht if he pays the barfine and takes her out of the bar, the fact that he had to catch her saying it into a hidden recording device argues against the concept of the kind of "promiscuous manner" that is obviously the focus of Thai law on the subject.
It is very important to actually read the source documents I present and not give your personal agency by allowing a senior member who is pushing a certain agenda (for his own reasons) to tell you what those documents say.Inside, they observed staff movements and customer service activities. Certainly, police confirmed foreign workers were present during the visit. According to the undercover officers, the workers offered sexual services to customers. Furthermore, they also confirmed that prostitution was offered inside the venue.

Here is what he has to say about prostitution establishments.
Wonder did he know that he was giving the perfect example of a prostitution establishment in this example?

Have you ever come across instances of that anywhere in Thailand? I haven't in 14 years of living here. Supposedly a couple of Blowjob Bars got shutdown because the ladies outside were describing their services loud enough to annoy a snitch. But I never heard any of those ladies doing that so loudly.

The answer to your question is never, because doing so has not broken any law that anyone has ever found, quoted or produced. Same with barfining a girl from a gogo bar, a beer bar or took a lady off the street or from a hotel lobby to your room.

Which is also why the Thai police have never busted anyone for merely doing that or closed down a gogo bar for being a "prostitution establishment" based on that going on at the place.
Then, by its very narrow definition in the Prevention and Suppression of Prostitution Act of 1996; meaning doing it "in a promiscuous manner", it is almost impossible for more than the potential customer and the potential prostitute to know exactly when, why and on what specific terms involving sex or not the notion occurred to one consenting adult to offer or ask for sex in exchange for money from another consenting adult in that venue much less them doing it in such a "promiscuous manner" that the general public would be in on the converstaion.

And even if it was happening that way a complaint would be filed by some aggrieved third party in the neighborhood that the police would then have to respond to and they would also need to stand by a while to see if they can hear those shouts too before they bust someone for precisely that. Still, as we have read in countless news reports of such busts, the bust would be for the shouting part and not for the sucking or fucking for money part.
See the screenshot below for the Act's very narrow definition for what they mean every time the word "prostitution" appears in that document's various Sections.

My best practice: is to not talk money or other details on the Thai Friendly app or site. Their servers will keep a record of your conversations that can be accessed without your permission. Both Whatsapp and Line have E2 E encryption that you can activate.Section 7.
Any person who advertises or agrees to advertise, induces or introduces by means of documents or printed matters, or by any means makes known to the public in a manner apparently indicative of importunity or solicitation for the prostitution of oneself or another person shall be liable to imprisonment for a term of six months to two years or to a fine of ten thousand to forty thousand Baht or to both.

That might be because defamation suits are criminal in nature. The class action regime is generally reserved for cases involving mass consumer losses, environmental harm, or systemic employment misconduct where individual litigation is impractical. Wake me up EihTooms when you have something to say about the defamation law in Thailand that is actually true.

Why would you want to stifle SubCmdr's ongoing success in proving over and over again with documented evidence and news reports that my contention about a major aspect of this entire InternationalSexGuide Forum, the mere agreement to engage in and exchange sex for money, money for sex, otherwise understood to be prostitution, among consenting adults is not a crime and punishable by any penalty whatsoever?

How great it is that any International Punter / Monger can take his consenting 18 year old or older adult lady to his hotel room for P4 P sex without the slightest worry that a police sting operation will intercept and bust them along the way, in the room or afterwards!
Granted, SubCmdr's inadvertent and surely unintentional contribution to making its wonderful non criminal characteristics in Thailand known to everyone by constantly and repeatedly trashing that and mischaracterizing that special gift of freedom and pleasure provided by Thailand while instead only providing more and more evidence of its non criminal characteristics while also putting him in the unenviable position of being liable for a potential lawsuit from every ISG member for imparing our reputation, defamaing us and making us targets of hatred, scorn and even false arrest with his unsupported claims that we are all engaged in what is "not legal in Thailand" and therefore committing sex crimes.
But, hey, some people just can't handle being gifted with such freedom and lack of P4P risk by an entire country that also has very good food, restaurants, nightclubs, hotel and residence accommodations, entertainment venues, cultural sites and so on. However, the rest of us shouldn't be denied his incomparable though inadvertent and unintentional contribution to getting the accurate word out about it. Well, with my and other posters' help, that is.
Of course, you and anyone else is always welcome to post a different topic in this thread that might be more important and pertinent to a central interest of virtually every member of ISG anytime. If you can think of one.

Posts: 7745I quoted the law. I apologize if that offended anyone. I didn't write it the law!
I just quoted the law and offered my opinion (as a lay person). I did not write the law. No one in the history of ISG has ever presented a legal opinion from a member of the bar that prostitution is legal in Thailand. That remains a undisputed fact. How do I know? Because if I was wrong about that someone would have presented it to me by now.
Useful input?
If you actually want to add to the discussion, give your opinion or tell me why it it has not happened that some dude got arrested for bar fining a gal from a club?. I do not have access to all the history or court records in Thailand. I cannot prove the absolute non-existence of this with infinite certainty. Unless you can tell me that you have reviewed those records.

You can either read the law, comprehend the law, interpret the law, and think for yourself. Which is what I choose to do. Or you can let a Senior Member lay person tell you what the law says. I am not trying to do that. I am giving my opinion as a lay person. Everyone is allowed to offer up their opinion as a lay person. You only create a problem for yourself if you are giving advice to others. I am only writing my opinion on how I see the law in Thailand. My opinion holds no dominion over the actions and opinions of another grown man.
Eyes wide open my brother!
It should be noted:
I am just giving my opinion (as a lay person) of the law after I have read it. No one is forced to read or reply to any of my posts. Many have announced they have me on ignore. I thank them for not wasting my time. Since I no longer have to read nonsensical responses from those individuals to my posts.

"In a promiscuous manner" Even the Prevention and Suppression of Prostitution Act of 1996 goes to extraordinary measures to make sure anyone reading its plain language on the topic understands that their definition of "prostitution" does not, repeat, does not mean the discreet exchange of money for sex or sex for money between consenting adults to be engaged in private but instead only applies to that act being committed "in a promiscuous manner."

Thanks for providing the specific official document quote that clarifies it, supports my contention about it and utterly refutes yours. The same as that attorney in Thailand did whose text and video clip you posted on the topic previously. So that's two cases of documented proof that I am stating my case accurately and you are not. Got anymore?
And since you have now decided that a "prostitution establishment" by your definition of it but most certainly not by the Act's definition of it could mean anywhere and everywhere that you claim to "know" a solicitation for that "in a promiscuous manner" form of prostitution could have and must have taken place, are you also now offering your services to the Thai Justice Department as an expert witness on the topic to help it win a case against every hotel owner, restaurant owner, bar owner, nightclub owner, apartment complex owner, massage shop owner, sex worker, customer, ISG member, etc, etc, etc that it is apparently your mission on this public online platform of ISG to impair the reputation of, subject to hatred and scorn and get shutdown, arrested, charged, convicted and sentenced for committing sex crimes, SubCmdr?

Different opinions I get, but this argument is functionally pointless. When was the last time some dude got arrested for bar fining a gal from a club?
Can we at least move on to argue about something useful, like the definition of "is?

Those saying Prostitution is Legal in Thailand are making a legally unsound and intellectually dishonest argument. My push back against it has been met with ad hominem attacks and defamatory statements. Let's start a the core:
Prevention And Suppression Of Prostitution Act B.E. 2539 (1996)
Definitions
Section 4
In this Act,
prostitution means sexual intercourse, or any other act, or the commission of any other act in order to gratify the sexual desire of another person in a promiscuous manner in return for earning or any other benefit, irrespective of whether the person who accepts the act and the person who commits the act are of the same sex or not;
prostitution establishment means a place established for prostitution or in which the prostitution is allowed, and shall include a place used for soliciting or procuring another person for prostitution; What does it mean to solicit for prostitution?Section 5.
Any person who, for the purpose of prostitution, solicits, induces, introduces herself or himself to, follows or importunes a person in a street, public place or any other place, which is committed openly and shamelessly or causes nuisance to the public, shall be liable to a fine not exceeding one thousand Baht.
Solicitation of prostitution is requesting, agreeing to pay, or negotiating for sexual services in exchange for money or something of value, even if no actual sexual act occurs. *.
Section 5 can apply to the Prostitute or the Trick.
What is a prostitution establishment?Section 6.
Any person who associates with another person in a prostitution establishment for the purpose of prostitution of oneself or another person shall be liable to imprisonment for a term not exceeding one month or to a fine not exceeding one thousand Baht or to both. If the offence under paragraph one is committed on account of compulsion or under an influence which cannot be avoided or resisted, the offender is not guilty.
That is a pretty wide definition. I can walk out my door and into a prostitution establishment in under five minutes. There is no signage. There are no markings. There are no advertisements. But I know EXACTLY what can be done in the location. And so does everyone else. Including the police. But as it has been established in previous posts I have made, all law enforcement is selective. The same way as the nominee laws are now being selectively enforced.prostitution establishment means a place established for prostitution or in which the prostitution is allowed, and shall include a place used for soliciting or procuring another person for prostitution;
Section 6 I have been told that this occurs all the time inside of in person venues all over Thailand. Most tricks have a out and so do the prostitutes. It's called ALCOHOL.
I have just covered how prostitution is actually engaged in Thailand. The hypotheticals I have been given are unrealistic. How do I know? Because when I ask for a real example on ISG where prostitution was engaged that was legal, no example could be found or given. If it is as certain Senior Members like to say, then giving an example puts no one in legal jeopardy now does it?If the offence under paragraph one is committed on account of compulsion or under an influence which cannot be avoided or resisted, the offender is not guilty.
Period! Full Stop!
Did you know that in the entire history of ISG no one has ever produced a legal opinion from a member of the bar that says prostitution is legal in Thailand?
