The Act defines prostitution as sexual acts performed to gratify another person's desires in a "promiscuous manner" in return for money or benefit. Legal sources explicitly state that*no clear definition*of "promiscuous manner" is provided in the statute. * Similarly, the phrase "open and shameless manner" used regarding solicitation is also*not clearly defined. *.
Consequently, the interpretation of these terms relies on judicial discretion and the specific circumstances of each case, such as whether the acts are causing a public nuisance or occurring in established prostitution establishments.
Prostitution Establishment means the place or premises arranged for prostitution or allowed for prostitution, and shall include the place used for making contact or procuring another person for prostitution.

Solicitation of prostitution*is requesting, agreeing to pay, or negotiating for sexual services in exchange for money or something of value, even if no actual sexual act occurs. *.
Section 6
Any person who associates with another person in a prostitution establishment for the purpose of prostitution of oneself or another person shall be liable to imprisonment for a term not exceeding one month or to a fine not exceeding one thousand Baht or to both. If the offense under paragraph one is committed on account of compulsion or under an influence which cannot be avoided or resisted, the offender is not guilty.
Let me break down the elements of the crime for you:

Our International Trick is associating with another person in a prostitution establishment.

They were both drunk!. ROTFLMAO!!
The Prosecution Rests your Honor!
Someone did not get the memo or actually read the law
Prostitution means the acceptance of sexual intercourse, the acceptance of any
other act, or the commission of any other act for sexual gratification of another person in a
promiscuous manner for remuneration or any other benefit, irrespective of whether the person
who accepts such act and the person who commits such act are of the same or opposite sex;Much more to it than that!Nuisance? Hardly. Visitors to Soi 6 (or Soi Cowboy) know what to expect and that is why they go there. They are not being annoyed. If so, they would turn around after venturing down / up the soi a mere 10 meters. Then, you have "community standards". I'd suggest that the same activities and conduct allowed on Soi 6 would be frowned upon at the Grand Palace or what Pho in BKK.

Maybe you did not get the memo: The Cmdr does not give a FUCK what anyone else thinks of him, especially those posting in this thread.SubCmdr, if you don't want to be hated and scorned by members of this Forum
Not doing anything of the sort.maybe you should stop defaming, impairing the reputation of and imputing in a manner likely to expose every other member of ISG to hatred and scorn by continually and repeatedly asserting on this online platform that what virtually every one of us post about regarding the mere exchange of money for sex with consenting adults age 18 and older in Thailand "is not legal in Thailand" and therefore makes all of us sex criminals?
Already dealt with this issue. I am waiting for any senior member (or for that matter anyone at all) to stop flapping there gums and actually take some action in real life it they feel that strongly about it.Otherwise, you might find yourself the target of a class-action complaint to the authorities for precisely the Sections of the Thai Criminal Code that you have so generously cited and more than once. That's a lot of members here who have admitted to what you continually and repeatedly in post after post try to make a case for the powers that be in Thailand to arrest, charge, prosecute and sentence us for being sex criminals.
Has anyone made a complaint against me to the Royal Thai Police Department. If they have then maybe they should follow up. Because I haven't been contacted by them, yet. ROTFLMAO!! So much big talk. So little action.Which, if you succeed in your apparent mission to accomplish exactly that, is a hell of a lot more defaming and impairing to the reputation of everyone on this Forum than simply pointing out what you are literally telling the world on this public online platform about us, our behavior and our activities in post after post.
They should. Because there is not a single person posting here that could file a complaint against me that would not receive a counter complaint against them filed by The Cmdr! What were those Sections again? Oh yes. Has everyone made a note of that? Keep it handy.
That is why a certain Senior Member has STFU about that stuff and started to once again make a legal argument from a lay understanding of the law and has also stopped the ad hominem attacks that put him in the same legal jeopardy he claims I am in.

Posts: 7970Only the Act's plain language definition of Prostitution is not legal in Thailand
At most, the owners of ThaiFriendly are at risk of getting busted for a crime based on Section 7 of that Thai document, not you or the lady based on any conversation you have on that site.

Otherwise, if the owners and management of TF forbid its subscribers from even discussing sex for money in person-to-person conversations about it on their site and bans anyone who does it, that's a personal business decision made by the proprietors of TF and nothing to do with Section 7 of that Act or what is specifically defined as illegal Prostitution in the Thai Code or Act, the only version of Prostitution between consenting adults deemed to be illegal under Thai law.

Not some Miriam Webster definition of it, not some revered old world legal textbook definition of it, not India's legal definition of it, not America's definition of it nor any rogue Thai police officer's personal definition of it. Only the clearly and in plain language definition of it found stated clearly and in plain language in the Thai Penal Code and the Prevention and Suppression of Prostitution Act of 1996 is illegal in Thailand.
The same goes for solicitation of Prostitution in Thailand. One or both of those Thai legal documents clearly and in plain language define the version of solicitation for Prostitution they deem to be illegal to be when it is done "openly and shamelessly in a public place causing a nuisance to the public" and no other version of it as defined by anyone else anywhere at anytime for any reason.
Both of those specifically and clearly in plain language defined and qualified illegal manners and methods of proposing the exchange of sex for money between consenting adults and fulfilling an agreement to do it in Thailand are exceedingly easy to avoid and almost never even occurs to a Thai sex worker and / or a potential customer to engage in the behavior that way. Otherwise, Thai law has no opinion or interest in what consenting adults agree to do and then do of a sexual nature for money or not, even if the personal conversation they had about it happens in a crowded gogo bar, a beer bar, a massage shop, the lobby of a hotel or on the corner of Sukhumvit and Asoke in Bangkok.

Is there a rational reason why you misquoted me. I said "Threads like this and many others show why many mongers are best avoided. Paid pussies are magnets for nutters. "I said "many mongers", not "mongers" are best avoided. Are you just stupid or are you really Sub Commander's sub? Take your syphilis meds.

So, dealing with girls on Thai Friendly I do not discuss money or sexual acts on the site itself. I tell girls I would like to meet them. Ask them to move over to Line or WhatsApp in order to discuss private details. I simply don't talk to girls that want to discuss details on the site. Even though that limit me. I still have more girls that agree to speak with me privately in order to make the arrangements that consenting adults over the age of 18 like to do!

The better way to look at it is this: prostitution, as legally defined under Thai law, is illegal. What you are arguing is that a private transaction between two consenting adults involving sex and money does not necessarily fall within that legal definition in every circumstance. Whether it does or not depends on the specific facts and circumstances.
So instead of continuing to argue about whether prostitution itself is legal or illegal in Thailand, because conduct that falls within the legal definition of prostitution is not legal, the more useful discussion would be whether the kinds of activities that guys on this forum, including me, actually engage in fall within that legal definition.
That is really the important distinction.
Rather than debating the general statement that "prostitution is illegal," the discussion should focus on what specific conduct Thai law actually prohibits, what conduct may fall outside that definition, and under what circumstances.
That way, guys can make their own informed decisions about how to engage in this hobby while understanding the actual legal risks involved.

Interesting logic.
"Threads like this show why mongers are best avoided. Paid pussy is a magnet for nutters. "
Fair enough, except this is a forum specifically for mongers, and you're posting on it.
So either you're the one completely normal bloke who wandered into a mongers' forum by accident, or you might want to allow for the possibility that being a monger doesn't automatically make everyone else a nutter.
Otherwise the conclusion seems to be: "Never meet mongers, says monger, while talking to mongers on a mongers' forum. "
The irony is doing quite a lot of work here.

Posts: 991Tooms, thanks for the welcome back. I don't want to beat a dead horse here, but honestly, you guys are arguing about something completely different. You need to look at it like this. Prostitution by legal definition is illegal in Thailand. What you are arguing is that to consenting adults can have a monetary transaction for sex, and that in itself may or may not fall under the legal definition of prostitution. It depends on the circumstances. So, instead of arguing whether prostitution is illegal or not in Thailand, you too should be analyzing whether or not certain activities that all of the guys here, including me, fall under the legal definition of prostitution or not. Based on that, guys can decide how to engage in this hobby safely.

I don't know if you noticed but the facts had to be revived more than ever recently thanks in part to a poster quoting your old arguments about it. LOL.

Until then, somebody really ought to point out on ISG the gross error being made when other posters insist what is normally being done regarding P4P in Thailand is illegal when it isn't, a crime when it isn't, subject to arrest and punishment when it isn't, the obvious implication by that false assertion being if one wishes to avoid those problems they should find a different source of income and a different country in which to monger. I don't mind being one of those ISG posters whenever necessary. Why not? It's easy to do since all the facts are on my side of the issue. LOL.
Thanks for the Hi and welcome back to these threads as well!

Posts: 7745Impossible to know anything about anybody online. Online anyone can be anybody. You don't really know jack about a person until you meet them in person. Online people show you what they want to see. How do I know this to be true? If you could really know a person by interactions online, the entire Bangkok / Pattaya Nightlife wouldn't exist. No need to enter prostitution establishments. No need to pay bar fines. No need to buy Lady Drinks. I have shown over and over again that using online methods like Thai Friendly provides way better value at lower cost. But yet, we have people for whom the online method does not work. Why? People want to interact with other people in real life. That is how you can really get an idea of how your prostitute will behave. You get the chance to feel her out (and up) and size her up, while buying her drinks in the prostitution establishment.
In the real world, no one would talk to another man in person the way these keyboard warriors pump out their mail bovine excrement while sitting safely in front of their screens behind their keyboard. Those of us who are familiar with the use of violence to resolve conflict understand this. Others, well they need to stay in online world. Because in the real world they would find out that their mouth is writing checks that their ass can't cash
