Bottom line is that you can pay for sex in Montreal, Toronto and Vancouver without worrying about being arrested as long as the lady is 18 or over, and the lady is not forced into prostitution.

There is no legal difference between getting an escort for outcall, at her incall, or at a full-service massage parlor.

Now let's discuss the law, which is called c36.

The basic statute says that prostitution is illegal.

Since Canada has the Nordic Model, some people describe the system as legal to sell, illegal to purchase.

That is an efficient way to put it, but not really correct. The problem in the Charter of Rights that says everyone is equal and the laws must be applied equally to every person, whether male or female, black, white or aboriginal.

To get around that frustrating part of the Constitution, the law says that the seller of sex is simply exempt from prosecution of the criminal act of prostitution.

The courts in the province of Ontario have not taken kindly to the blanket exclusion of sellers of sex from prosecution and several of the Ontario court cases have essentially ruled c36 as being unconstitutional. But the cases limited the scope of the decisions to the province of Ontario.

The reason that these cases are not that big of a deal is that long before those cases were heard, the police in Montreal, Toronto and Vancouver announced a prioritization policy, often called a non enforcement bulletin, where they said that consensual adult prostitution would receive the lowest possible priority, unless evidence exists that the seller of sex is a minor or that she was forced to commit the compensated sex act.

The Ontario cases, by the way, were brought in jurisdictions outside of Toronto.

So life goes on as though c36 never happened. If you book a lady from any of the major agencies or book an independent who has her own website, she is going to be 18 or over, and not coerced. If you want to approach this with an abundance of caution, stay away from mass classified advertising sites like LeoList and Humpchies. There is no real control of who is advertising on those low-end sites.

Massage parlors are certainly fine, also.

Law enforcement within Montreal will not give you any problem. You should however, delete phone calls and texts to escorts and escort agencies from your phone before going through Border Patrol. And don't have auto log-in on your phone or laptop to an email address you use to communicate with sex workers. Border Patrol has some bad actors who go on power trips. They are federal and are not part of the local law enforcement agencies that issued the prioritization policy. About 1 out of 100 visitors gets selected for additional screening in a separate room, and they do go through your basic phone history.
