Unlike western countries (most of them) where the checks and balances on LE is very clear cut, where the LE themselves are under radar to follow the rule book when raiding / arresting / detaining somebody if they don't have clear cut info or evidence, which can be proven in courts, they won't venture into it. They can be sued / dismissed or LE themselves imprisoned for going against the book. Like in US, publicly soliciting for sex is a crime, and so is trafficking. If you hook up with a WG in a mall or a bar or a train without a mention of money involved (as a proof), its not a crime. For both the provider and receiver. In some countries like Netherlands and Germany etc, there are designated areas where even public solicitation is allowed. However, in India, there are neither such regulations nor seldom those rules are followed by LE. Places like GB in Delhi, Sg in kol, KP, NL, CH etc in Mumbai are age old arrangements between the sex industry / mafia / govt,. / LE. Those places also can be raided / arrested. Its up to the guy caught in the scene to prove his innocence, and most of the times the guys caught in the circumstance will most likely pay bribes and settle without the issue coming out in public, which will affect their personal / professional lives. Thats what the LE plays on. The fear factor.

As far as legal status is concerned, as long as the provider (the WG) doesn't solicit her services in public or through any forum (news paper / internet or whichever media, in a written / published manner which can later become evidence) and there is no evidence of money changing hands between the buyer and the provider (either WG directly or through an SP), the police cannot take any action. If there is a middle person involved in the act of selling sex, its considered trafficking and the buyer and the agent are in big problem and the girl is seen as a victim. So in plain words, if you take an indie either to any private place or even to an hotel and if there is no proof of money having been exchanged, LE cannot do anything. But then yes, if you have not provided an ID or provided a fake ID at the hotel, they can question both of you or either of you on those lines (providing both IDs is a govt rule. They can verify / question you on that, not for commercial sex. And in that process of questioning, either of you spill the beans that this is a commercially transacted sex, then both are in trouble. This is usually the problem. Most WG will be in LE radar and perhaps on their records too. If the LE come across a known WG with a client, they know for sure its a commercial transaction, and they know the ways to spill the beans and either take the case legally or extract money to close the case.

Your second question if you take a girl through an SP, that's not safe either. Its more dangerous. If caught the girl can always cook up some story like she was asked to attend a job interview or some assignment etc, and a case of physical abuse / [CodeWord123] can be hoisted on you, and the Sp for being a party to it as a trafficker / cheating case and many more sections under the law. They can put a case of [CodeWord123], illegal confinement, cheating and being party to trafficking etc on the buyer. In this case too either the case will take legal route or bribed extracted to close the case.

So bottom line, mongering in India and many other countries where prostitution is illegal, is fraught with dangers. Specially if there are middle men involved. Most of the cases you read where hotels are raided and girls caught in act (the famous Bengali actress case in Hyderabad or any of such cases) happen because there is an SP involved and either is a tip off or the LE is on the trail of both the SP and the girl for sometime, and they have enough evidence to prove, before actual raids / arrests. If the girl is acting purely as an Indie, then chances are very rare of a raid / LE action.

Hope this answers some frequently asked question on mongering and LE action. If you are caught in an MP, LEs life is very simple. Its a commercial establishment and you have paid money for the service. If the service includes any sexual activity, and if they have proof of the same either in the form of a decoy or a witness or an informer who went in, or some video or written evidence, the LE will simply take action, if they so wish to.

There is no difference between what he is going to do and a pimp. Though he is doing it unknowingly. He is taking a money and facilitating sex trade. Just think what does a pimp do; he takes money from the customer and provides a girl. So in front of law this is illegal.
