I understand having a brothel is illegal. But if a woman offers sex during a massage, is that also illegal? No right? Prostitution is not illegal in India.

However, law being law, has caveats and various acts under prostitution are illegal / unlawful.

So a women offering sex as service is legal! But, running a brothel outside of legal jurisdiction (such as GB Road), "pimping" or earning money through sex is illegal etc and so is human trafficking.

Also, if I setup a brothel "outside" of the view of "moral society" such as in middle of a desert, it is perfectly legal in Indian law to run that place for prostitution.

Places like spa's, any flat or apartments in city are near the "moral society" making them objectionable.

Now, keep in mind that the whole country knows about places like GB road exists. Those brothels don't shut down because that area is "legal" under our law which dates back to GB Road being the hub for foreigners to arrive by train to fuck exotic beauties under colonial rule. Similar places exists in Mumbai, Kolkotta etc and are all legal.

Have you ever the news "GB Road brothel shut down for prostitution"? No. You will hear stuff like "minors rescued from GB road" etc.
