Is the basic act of consenting adults exchanging sex for money illegal and a crime in Thailand? I am open to the possibility there there is an enforceable sentence or phrase somewhere in some Code or Act that makes it so. But I haven't seen or found it yet.
Interesting point about bar owners motives. It sounds reasonable that they would do that. Pretty clever too.

It's nice you're open to being wrong. Not a very common trait. However, you're not wrong. There's no such sentence / phrase. First, because it just isn't in the Act. But also, logically it can't exist.

There is a saying- The exception that proves the rule.

On one street there are signs that say No Parking.

On the next street are signs saying No Parking On Tuesday.

On the first street, the rule is clear- no parking.

On the second street the rule is clear, but unsaid- parking is allowed. Tuesday is the exception. Otherwise, why not have a No Parking sign?

Section 5 of the Prevention and Suppression of Prostitution Act prohibits public solicitation for prostitution in a manner deemed "open, shameful, or disturbing to the public. ".

Here, although unsaid, the rule is- prostitution is legal. However, there are exceptions- except in a manner deemed open, shameful, etc. And there are other exceptions. Quite a few in fact. But they are all exceptions to what? To legal prostitution. Otherwise, why not just say- prostitution in illegal in Thailand?

From the Thai Narcotics Act be. E. 2545 (2002) "No person shall import / export narcotics of category II, unless obtained the license from the licensing authority for specific cases in government service".

    There it is. Very straightforward.

The Thai legislature can write very succinct laws. They can also write very convoluted laws. I imagine they have good reasons for each.

If they wanted to outlaw prostitution in the Kingdom, they would have said just that. Like when they wanted to prohibit bringing in Category II narcotics in, they said just that. Nothing about what manner they were brought in, whether it offended the public, whether it was done openly and on and on. You cannot bring category II narcotics into Thailand without the proper authorization. End of the story. So if prostitution in and of itself is illegal, why didn't the government just say so?

Is it always and only about the tangential issues and qualifiers? Probably.

Authorities charged them under Section 5 of the Prevention and Suppression of Prostitution Act, be. E. 2539 (1996), which prohibits public solicitation for prostitution in a manner deemed open, shameful, or disturbing to the public. ".

You can carry on now. I think you need to argue over the "deemed" clause.
Yep, there it is as usual; the necessary tangential issue or qualifier that provides a legal reason for the police to arrest, round up, herd, sweep or whatever terms are preferred, Sex Workers for something vaguely related to prostitution but, mysteriously, never for the actual act of consenting adults exchanging sex for money. This time they pulled out the old "open, shameful or disturbing to the public" premise.

I suppose we could sometimes replace the words "disturbing to the public" with "disturbing to nearby competitor Sex For Pay venues" like bars, massage shops, gentleman's clubs and so on. Especially those for which the "sex in exchange for money" part requires paying a barfine, expecting the customer to buy ladydrinks, renting an on-bar-premises room and so on that are not required or expected with street girl sex. And these immigrant hooker sweeps are also probably "disturbing" to the local Thai hookers as well. None of whom were rounded up for anything in this case, I notice.

    Nor anyone's customers.

Why, one would think the police and legal authorities know there is nothing in the books, in The Thai Penal Code, The Prostitution Prevention and Suppression Act or anywhere else that gives them the legal power to arrest, charge or drag through a court case any consenting adults, foreign or domestic, who agree to, are about to or already have exchanged sex for money. And that is apparently even more certain for the customers or potential customers since we read nary a report about so much as one of them being tossed into those round ups, arrested and charged with anything.

But, you're right, the only question that is never fully answered with these "disturbing the peace" type tangential issues and qualifiers arrests is how does one define "deemed" in the eyes and ears of the police.

Maybe a general rule of thumb is, at minimum, if the Queen was standing on the street within a a meter of the negotiation and could hear and see enough to make her blush, that would be "deemed" a public disturbance.

"Loitering", "showed signs of prostitution", "advertised for illicit services", "visa violations", etc etc etc.

And through it all there is not one mention of either a prostitute or a customer being arrested specifically For Prostitution.

Yet, the "trust us, prostitution is a crime / illegal" side will read those very tangential issue and qualifier words, see that the critical words are nowhere to be found and still swear the report "proves" that prostitution is a crime / illegal in Thailand. Wow.

Hell, we even had one posted news report describing the prostitutes being rounded up to collect their identification information in case they DID commit a crime sometime in the future and it was still taken as "proof" that they were arrested for the "crime" of prostitution. LOL..

Yet they write as if what they do is universal for everyone the visits Thailand. When I point out that I am doing something completely different. When I am doing something that does not resemble what they are doing in the least bit, their response is either that is because you don't know what you are doing or it is because you are new.

That is a cop out on the part of the individuals who consider themselves to be experienced. They should know that their personal experiences do not an cannot invalidate the personal experiences of others.

Take for example: 1200 Todo La Noche guy who fucks 99% of the girls he meets in Thailand bare. I am in no position to say that he is lying on his dick. On the other hand he is in no position to say that so how I am not doing something write if I cannot do what he does. I have not experienced that. 50% of the girls I meet want to use condoms. My dick still works so I don't give a fuck. In my opinion, saying you cannot cum or stay hard in a condom is a mental issue. Maybe they need to abstain more or focus on really finding girls that turn them on instead of just fucking the first thing willing to spread their leg at their price point. Something else they could do is really focus on girls THEY find attractive instead of a false image projected by other of what they should find attractive.

In my opinion, that is the problem with the posters in the Thailand threads in general. They think they know it all and their experiences define what is THE experience in Thailand.

If you don't invite girls over to your room to drink and sit on their face then you are doing something wrong. They get so defensive as to write a long post on the details of face sitting and then call me out because I am not interested in those activities. Especially paying for them.

Then we have geriatric sexual fitness guy. Wanting to take on everyone in the Chang My threads over the location of massage places. Ok, Ok, you are seventy fucking years old and still fucking. Can someone please cue the applause soundtrack?

Then we have the guy that cannot compete again Korean and Japanese guys. He does not like that I keep pointing that out. But he wrote the words. I am in no position to say that is not the case when he is where ever he goes to drink soft drinks and recruit girls to fuck. But I can say I have never experienced the problems that he describes. And personally it sounds to me that if he just spent some more money then problem resolved. Or it could be that I just don't go where he goes and that the girls that choose to deal with me do not have the same preferences as the knock kneed bimbos walking like hos that most Farangs prefer.

I'm going to sum it up by saying that in my opinion there is too much talking about what others are doing and clearly not enough talking about what they are actually doing. Look over in Pattaya Reports. Endless chest beating about the legality or illegality of prostitution in Thailand. I just scanned that shit thinking: are any of those characters actually fucking prostitutes in Thailand. Perhaps those that are afraid of their own shadow can just use game and only deal with non-pros. Certainly buying a girls ice cream or dinner and then talking her out of her panties isn't illegal. LOL!

    How you like me now?

Totally agree, why would I give one damn what kind of music the girl likes? Not like I'm planning on having her move in with me. And even then.

Also agree on all these wannabe 'experts' . Lots of them here who seem to have no idea how obvious it is that they're full of crap.

Some have an interest in making punters think it is illegal when it is not.

Because you haven't provided anything to contribute to an answer as to whether it's legal or not. BTW, I bet that impresses the ladies. I should try it because I was in the legal profession myself.
If someone had friends who owned bars where ladydrinks and barfines are sold or had a personal interest in them as well, I could see them wanting to promote the idea that making an arrangement for Sex In Exchange For Money outside of that system, the basic act of it, was illegal even when it is not. They would do so in the hope that punters would conclude that making the arrangement less openly and publicly exposed to observation in the bar was less risky than on the street right outside of the bar or online where no ladydrinks or barfines are required or expected.

I could also see those type of venues' owners and management making the call to the police to investigate this or that serious crime of "showing signs of prostitution", "loitering" "creating a public nuisance" etc on the street and when immigrants with likely visa issues are interloping on the market whether behind closed doors of a venue or not.

The local police would certainly fit the profile of those kind of interested parties. As well as many others.

However, that still doesn't make the basic act of consenting adults exchanging sex for money illegal or a crime in Thailand. No matter how much those various interested parties would like for us to think so.

And that is but one factor for why a discussion of it on the specific Bangkok Reports, Pattaya Reports or just about anywhere in the Thai Play-For-Pay-related forums is perfectly appropriate and valuable.

Moving it to the "Stupid Shit and Rants" forum only serves the mission of those aforementioned interested parties. Which is why I predicted it was destined to be moved sooner or later, but certainly as soon as it looked like the "trust us, it's illegal, a crime" side hit a brick wall on producing any evidence for their side.

Is the basic act of consenting adults exchanging sex for money illegal and a crime in Thailand? I am open to the possibility there there is an enforceable sentence or phrase somewhere in some Code or Act that makes it so. But I haven't seen or found it yet. Nor have I read about or observed a law enforcement / police action that irrefutably targeted precisely that act of consenting adults exchanging money for sex without one or more of the usual tangential issues or qualifiers present.

Until then, there is no other conclusion but to go with the classic legal principle of "qui tacet consentire videtur", he who is silent seems to consent.

That being the case, by what is and is not clearly stated in the law and evidenced by adjudication in the courts, Thailand has given its consent via silence on the issue for consenting adults to exchange sex for money without fear of arrest and conviction of a crime.

Here we have a individual who does not even live in Pattaya giving me advice on how to conduct my affairs here in Pattaya. Individuals who don't live here have nothing to contribute to those who actually do live here.

International Tricks that do not live here don't know anything about Thai Tax Law. Why would they? They are just visitors like Explorer.

International Tricks who are not single have no place to give relationship advice to anyone because they are either breaking their marriage vows or lying to their girlfriend (s).

I am not doing any of that. In fact I find the transactional nature of relationships in Thailand quite refreshing. As opposed to our current relationship counselor running from the Thai Tax man and and hold up in Brazil while flying Thai prostitutes around the world.

I recognize the nature of relationships here in Thailand because even through we have people calling me new after how many months of boots on the ground living here in Pattaya? Where do they gain the expertise in Pattya or moral authority to do that when they don't even live here? In terms of absolute number of RON's in country I challenge anyone who does not live here to put their numbers up against mine.

    Eighteen months times thirty equals?

The math word problem will be left to my readers who learned basic arithmetic in elementary school. The same exact skills I use to evaluate the financial aspects of a real estate investment in Pattaya
