They just keep on keeping on. It is like making a last stand in a world taken over by Zombies.

Posts: 7748The Cmdr is not in Brazil, Cambodia or Republica Dominicana posting about Thailand
The beauty of my response is that I am writing from Pattaya Enjoying Pattaya. Have been posted up in Pattaya for 18 months now. I find it interesting that people are still in denial about that. I was all over Pattaya all day yesterday. During my trip along Beach Road on the Baht Bus, the bars were packed. Now I don't know where the people hang out that are saying there are no tourists in Pattaya or that they are here but they are not visiting the venues. Because what I saw (with my own eyes) along Beach Road yesterday was completely contrary to what others are reporting.
Are you sure I am posting from a basement half a world away? Name where you want to meet in Pattaya and I will shatter your manufactured reality. I will be waiting for either the retraction of your lie here or a PM to set up a meeting (like a man) in order to change your perspective.

No it doesn't. There are lots of factors that determine what a girl gets paid. Think.

Do what I do and block the lunatic. I'm here in Pattaya and I have no time to read the postings of a guy in a basement half a world away.

Posts: 113Interesting point about bar owners motives. It sounds reasonable that they would do that. Pretty clever too.

There is a saying- The exception that proves the rule.
On one street there are signs that say No Parking.
On the next street are signs saying No Parking On Tuesday.
On the first street, the rule is clear- no parking.
On the second street the rule is clear, but unsaid- parking is allowed. Tuesday is the exception. Otherwise, why not have a No Parking sign?
Section 5 of the Prevention and Suppression of Prostitution Act prohibits public solicitation for prostitution in a manner deemed "open, shameful, or disturbing to the public. ".
Here, although unsaid, the rule is- prostitution is legal. However, there are exceptions- except in a manner deemed open, shameful, etc. And there are other exceptions. Quite a few in fact. But they are all exceptions to what? To legal prostitution. Otherwise, why not just say- prostitution in illegal in Thailand?
From the Thai Narcotics Act be. E. 2545 (2002) "No person shall import / export narcotics of category II, unless obtained the license from the licensing authority for specific cases in government service".
There it is. Very straightforward.
The Thai legislature can write very succinct laws. They can also write very convoluted laws. I imagine they have good reasons for each.
If they wanted to outlaw prostitution in the Kingdom, they would have said just that. Like when they wanted to prohibit bringing in Category II narcotics in, they said just that. Nothing about what manner they were brought in, whether it offended the public, whether it was done openly and on and on. You cannot bring category II narcotics into Thailand without the proper authorization. End of the story. So if prostitution in and of itself is illegal, why didn't the government just say so?

Posts: 7971Is it always and only about the tangential issues and qualifiers? Probably.
Yep, there it is as usual; the necessary tangential issue or qualifier that provides a legal reason for the police to arrest, round up, herd, sweep or whatever terms are preferred, Sex Workers for something vaguely related to prostitution but, mysteriously, never for the actual act of consenting adults exchanging sex for money. This time they pulled out the old "open, shameful or disturbing to the public" premise.

Especially those for which the "sex in exchange for money" part requires paying a barfine, expecting the customer to buy ladydrinks, renting an on-bar-premises room and so on that are not required or expected with street girl sex. And these immigrant hooker sweeps are also probably "disturbing" to the local Thai hookers as well. None of whom were rounded up for anything in this case, I notice.
Nor anyone's customers.
Why, one would think the police and legal authorities know there is nothing in the books, in The Thai Penal Code, The Prostitution Prevention and Suppression Act or anywhere else that gives them the legal power to arrest, charge or drag through a court case any consenting adults, foreign or domestic, who agree to, are about to or already have exchanged sex for money. And that is apparently even more certain for the customers or potential customers since we read nary a report about so much as one of them being tossed into those round ups, arrested and charged with anything.
But, you're right, the only question that is never fully answered with these "disturbing the peace" type tangential issues and qualifiers arrests is how does one define "deemed" in the eyes and ears of the police.
Maybe a general rule of thumb is, at minimum, if the Queen was standing on the street within a a meter of the negotiation and could hear and see enough to make her blush, that would be "deemed" a public disturbance.

Totally agree, why would I give one damn what kind of music the girl likes? Not like I'm planning on having her move in with me. And even then.

Posts: 7971Some have an interest in making punters think it is illegal when it is not.
If someone had friends who owned bars where ladydrinks and barfines are sold or had a personal interest in them as well, I could see them wanting to promote the idea that making an arrangement for Sex In Exchange For Money outside of that system, the basic act of it, was illegal even when it is not. They would do so in the hope that punters would conclude that making the arrangement less openly and publicly exposed to observation in the bar was less risky than on the street right outside of the bar or online where no ladydrinks or barfines are required or expected.

The local police would certainly fit the profile of those kind of interested parties. As well as many others.
However, that still doesn't make the basic act of consenting adults exchanging sex for money illegal or a crime in Thailand. No matter how much those various interested parties would like for us to think so.
And that is but one factor for why a discussion of it on the specific Bangkok Reports, Pattaya Reports or just about anywhere in the Thai Play-For-Pay-related forums is perfectly appropriate and valuable.
Moving it to the "Stupid Shit and Rants" forum only serves the mission of those aforementioned interested parties. Which is why I predicted it was destined to be moved sooner or later, but certainly as soon as it looked like the "trust us, it's illegal, a crime" side hit a brick wall on producing any evidence for their side.
Is the basic act of consenting adults exchanging sex for money illegal and a crime in Thailand? I am open to the possibility there there is an enforceable sentence or phrase somewhere in some Code or Act that makes it so. But I haven't seen or found it yet. Nor have I read about or observed a law enforcement / police action that irrefutably targeted precisely that act of consenting adults exchanging money for sex without one or more of the usual tangential issues or qualifiers present.
Until then, there is no other conclusion but to go with the classic legal principle of "qui tacet consentire videtur", he who is silent seems to consent.
That being the case, by what is and is not clearly stated in the law and evidenced by adjudication in the courts, Thailand has given its consent via silence on the issue for consenting adults to exchange sex for money without fear of arrest and conviction of a crime.
