I was ready to leave this entire subject alone. But EihTooms keeps proffering his incorrect lay opinion upon us. What are we to expect from a non-Thai Citizen, Non-member of the bar of Thailand who insists he knows more than the individuals who wrote the law originally in Thai.

His main position is that enforcement efforts show he is right. My position is that is a incorrect assumptions. He himself has acknowledged that the law for nominee structures have been on the books for year. Individuals read the law and took actions they believed were within the law. They received legal counsel that they were operating within the law. Yet, when enforcement efforts changed a completely different reading was interpreted by the controlling legal authorities. Arrests were made. Property was seized. The exact same situation exists with the prostitution laws in Thailand.

Prostitution between consenting adults over the age of 18 has no criminal penalty. Problem is when I asked the International Tricks who are engaged in International Trickin activities if that is how they hire their prostitutes, the answer was:

When someone shows me a legal opinion written and signed by a member of the bar of Thailand or a ruling from a Thai Court that says: prostitution is legal in Thailand, that is when I will change my opinion on the subject.

That'll happen right after you see a legal opinion stating Smiling While Driving is legal anywhere.

There are no laws on the books in Thailand stating the mere person-to-person discussion and agreement to exchange money for sex or sex for money between consenting adults and then their retreating to private quarters to fulfill that agreement is illegal, a crime or punishable by any penalty. Which is why there are no media reports of anyone being arrested for that, charged with a crime for doing it or legally punished for it despite that being the way solicitation for prostitution is done 99.99% of the time by us punters and prostitutes on the street, in bars, in massage shops, in nightclubs, in hotel lobbies, online and virtually everywhere throughout Thailand and it wouldn't occur to us or them to do it any other way.

And the definition of Promiscuous Manner in this context would certainly mean "random, disorderly, indiscriminately and unrestrained."

Having been inside Thermae many times to have a drink, eat some popcorn, relax, people watch and incidentally on occasion engage in the perfectly legal, according to Thai Law, person-to-person discussion about exchanging money for sex with a consenting adult and on occasion the also perfectly legal, according to Thai Law, retreating to private quarters with my prostitute of choice to fulfill any such agreement, I don't see how Thermae qualifies under Thai Law as anything but what the sign outside suggests it is and what in fact it is inside; a cafe and bar one enters to have a drink, eat some food, relax, people watch, meet new friends and as an aside perhaps meet a consenting adult who chooses to engage in a perfectly legal discussion and agreement to exchange money for sex.
